ITEM IV: FINAL PLAT FOR THE CREATION OF A 1-LOT MULTIPLE-FAMILY
RESIDENTIAL SUBDIVISION AT 2022 OLIVIA ROAD (LAKE BUTTE DES
MORTS DEVELOPMENT PHASE 2)
GENERAL INFORMATION
Petitioner: ISG, Inc.
Owner: Red Earth, LLC
Actions Requested:
ISG, Inc. is requesting approval of a final plat containing one multi-family lot named Lake Butte
des Morts Development Phase 2.
Applicable Ordinance Provisions:
Requirements governing platting are located within Article XIII, Subdivisions; Sections 30-441
through 30-446 of the Zoning Ordinance.
Property Location and Background Information:
The subject site is part of an
undeveloped lot identified as Lot 1
on the Lake Butte des Morts Drive
Preliminary Plat approved by the
Common Council on May 28, 2024
(Res 24-293). The property will be
developed as Phase 2 of the six-
phase Lake Butte des Morts
Development which is planned for
a total 522 multi-family units. Phase
1 is currently under construction
consisting of two 40-unit
apartments and club house while
Phase 2 will consist of an 82-unit
apartment building. The property is
zoned Neighborhood Mixed Use
with a Planned Development
Overlay (NMU-PD). The Common Council approved a Specific Implementation Plan for Phases 2
through 6 for this development at its March 12, 2024 meeting (Res 24-123).
The surrounding area, except for Phase 1 to the south, is generally undeveloped. Lake Butte des
Morts Drive, a frontage road for U. S. Highway 45, is located to the east while the WIOUWASH

State Recreational Trail and the Lake Butte des Morts water body are located to the west. Single
family residential developments are located approximately ¼ mile to the northwest and ¼ mile to
the southwest. The Comprehensive Land Use Plan Map identifies this area suitable for mixed-use
development which includes multi-family residential.

ANALYSIS
Design
The 11.45-acre lot is located at the northwest corner of Lake Butte des Morts Drive and Olivia
Road with 629 and 373 feet of street frontage, respectively. Of the 11.45 acres, approximately 8.32
acres have been mapped as wetlands or waterway leaving 3.13 acres of developable area.
The proposed lot meets the NMU District minimum code requirements in regard to width (60 feet
minimum), depth (100 feet minimum) and area (1,200 square feet per dwelling unit minimum).
With the proposed dwelling unit total of 82 units on the 11.45 acre area, the density for the
development is considered low at approximately 7.2 units per acre (one unit per 6,085 square
feet). The NMU District has a maximum density of 36 units per acre or one unit per 1,200 square
feet.
The proposed plat includes new right-of-way dedication. The 60-foot wide east-west street Olivia
Road will be extended southwesterly approximately 314 feet, then it turns southeasterly
approximately 195 feet as a new street named Blaire Boulevard. The streets match what was
approved on the preliminary plat.

Engineering & Storm Water Management
Water, sanitary sewer, storm sewer, paving, street lighting and grading and drainage plans have
been submitted and are under review by the Department of Public Works. Approved plans will
be required prior to plat approval by the Common Council. The final plat does show all required
easements for private and public facilities and a temporary cul-de-sac easement at the south end
of Blaire Boulevard.
Police and Fire Departments and the Oshkosh Area School District
The City Police and Fire Departments have reviewed the final plat and have not indicated any
problems servicing the proposed development. The Oshkosh Area School District has been
notified of the proposed subdivision and has not responded with concerns about being able to
accommodate the potential increase to the student population.
Parkland Dedication
The plat does not include area for parkland dedication. The Parks Department reported there is a
need for a community park in this area of the City, however, the City’s Comprehensive Outdoor

Recreational Plan (CORP) identifies a suitable location
further to the northwest to better serve projected
population increases in this area. Instead of land
dedication, the City recommended receiving fees in-
lieu-of which amounts to $27,060. As parkland fees are
collected, the City will be able to purchase land in this
area for future park development.
Terrace Tree Plans
A terrace tree plan has been submitted as part of the
overall landscaping plan for Phase 2. A total of 18 trees
are proposed, 9 on the north side and 9 on the south
side of Olivia Road. The number of trees exceed the
minimum requirement of one tree per 60 feet of lot
frontage. Species include a variety of six different
deciduous trees. Final tree selection and placement
will be coordinated with the City Forester as time of
planting nears.
The terrace tree plan only shows plantings directly adjacent to Phase 2. Terrace trees further to
the west and south will be addressed at future phases.
RECOMMENDATIONS/CONDITIONS
Staff recommends approval of the one lot Lake Butte
des Morts Phase 2 final plat with the following
condition:
1. All civil design plans shall be approved by the
Department of Public Works prior to Common
Council Approval.

Public Utility Easements
1.Areas identified as a Public Utility Easement are Easements in, over, under, and
across the property that are granted to all Public Utilities as defined by Wisconsin
Law. The common utility services expected to use the Easement are electricity
and electric energy, natural gas, telephone, and cable television, although this list
is not comprehensive and does not preclude other Public Utilities or Public Utility
Services from using this Easement.
2.The Easements are non-exclusive, and must be reasonably shared with other
Public Utilities and with private property services that need to cross the Easement
to connect to Municipal and/or other public services in the public right-of-way.
3.Public Utilities may use these Easements to inspect, construct, install, operate,
repair, maintain, and replace all lawful equipment and facilities that are consistent
with the Public Utilities' services provided. Public Utilities must restore, or cause to
be restored, the property to a condition that is substantially similar to the property
condition before the Public Utility performed its work.
4.All easements benefiting the Municipality, including drainage easements whether
or not they are Municipal Utility Easements, have a priority over Public Utility
Easements and private easements.
5.Sidewalks, driveways, private storm drainage features, and private storm sewers
are allowed to be installed over, under, and across the Public Utility Easement.
The storm drainage and storm sewer locations are in private easements identified
on the Plat. Sidewalks and driveways will be installed upon later development.
Diggers hotline is always required before installation. Otherwise, the surface of the
Easement must remain clear of buildings, structures, and vegetation except lawn
grass. Fences compliant with the Municipal Code are only allowed with
permission of the Public Utilities. After the final grade of the property is
established, it shall not be altered by more than four inches without the written
consent of the Public Utilities using the Easement at that time.
6.Public Utilities are not responsible for damage to roots or vegetation primarily
located in adjoining property but extending into the Easement, whether above or
below ground. Public Utilities are allowed to trim trees or vegetation within the
Easement or nearby as allowed by law.
7.All use of the Easement, whether by the property owner or by Public Utilities, must
be compliant with the Municipal Code and nothing in the foregoing easement
conditions alter, limit, or waive any requirement of the Municipal Code.
