Dear Mr. Foster:
On October 13th the Board of Appeals approved your variance request to construct an addition to a
dwelling located within the 100-year flood fringe of Sawyer Creek that will have a 3et foot fill radius
subject to the following condition:
1. The reduced floodplain fill radius along the north side of the property be constructed with a retaining
wall, adjacent to the floodway boundary line.
The decision of the Board was filed in the Planning Services Division Office of the Department of
Community Development on October 14, 2004. Per Section 30-6(C)(3) and (4) of the City of Oshkosh
Zoning Ordinance, your variance will expire on April 13, 2005 unless you have obtained a permit for the
activity allowed by the variance. If you fail to get a permit by this date, you must reapply for a variance
if you intend to go ahead with the activity allowed by the variance.
Please be advised that any person or persons aggrieved by any decision of the Board of Appeals may
commence action in Circuit Court within thirty (30) days after the filing of the decision. Permits may
be issued on approval of the Board, but you should be aware that further action could take place
until as much as 30 days after the date ofthe decision.
Building permits may be applied for from the Inspection Services Division in Room 205 at the Oshkosh
City Hall between 7:30 - 8:30 AM and 12:30 - 1:30 PM, Monday thru Friday, or call (920) 236-5050 for
an appointment. Please bring all required building plans and information necessary for review when
obtaining your building permit.

1485 S. Oakwood Road, Nonconforming Structure Calculations for Addition
The DNR has verified that the principal structure is located within the 100 year floodfunge of Sawyer Creek, and the
principal structure sits on a basement that is below the 100 year floodfringe elevation for the area. Although the
owner is proposing to construct an improvement that will adequately protect the structure fiom future flooding, the
structure will continue to be considered located in the 100 year floodfiinge. The structure nonconfonning due to the
requirement that land may not be removed fiom floodfiinge unless the entire area of the habitable area of the
structure has an elevation that is 2 feet above the 100 year flood elevation at the site, which happens to be 779.7
NGVD (Mean Sea Level). The following calculations are required to keep track of the value of improvements to
nonconfonning structures, so that the 50% of the current total assessed value for this structure is not exceeded for the
lifetime of this structure.
NOTE: A $5,000 structural improvement was added to the nonconfonning principal structure in 1999.

structure at 1485 S. Oakwood Road may not exceed $58,600.
**Note: Per a discussion with Mike Russo, shorelandlwetlandlfloodplain zoning specialist for the DNR N.E.W.,
property may not be removed fiom the 100 year floodfiinge unless the entire area is filled to an elevation two (2) feet
above the 100 year floodfringe elevation. Building and filling around his existing basement will not eliminate the
fact that the basement is below the 100 year flood elevation. Rather than fill his basement area, survey it to verify it
has been filled to an elevation that is two (2) feet above the 100 year flood elevation, have the area removed, and
then re-excavate the basement, the owner understands that his property is still classified as "in" the 100 year
floodfiinge of Sawyer Creek. **
