Main Street PLAN COMMISSION STAFF REPORT MARCH 18, 2025 CONSENT AGENDA ITEM I-A: RECOMMENDATION PERTAINING TO GRANTING OF STORM SEWER LATERAL EASEMENT AT 205 STATE STREET (200 EAST PARKING LOT) TO 206 NORTH MAIN STREET GENERAL INFORMATION Applicants: City of Oshkosh Department of Public Works Owner: City of Oshkosh Actions Requested: The City of Oshkosh Department of Public Works is requesting approval to grant a storm sewer lateral easement through property owned by the City of Oshkosh located at 205 State Street (200 East Parking Lot). Under Section 62.23 of the Wisconsin Statutes and Chapter 30 of the City’s Municipal Code, the Plan Commission is responsible to review and advise the Council on interests in land for public utility purposes. The Council will then, based upon the recommendation from Plan Commission, make a final determination on whether to grant the easement as requested. Property Location and Background Information: The 0.38-acre subject is located at the northwest corner of State Street and Otter Avenue. The lot is used as a 32-stall parking lot owned and operated by the City of Oshkosh Transportation Department. The applicant is requesting the granting of a storm sewer lateral easement to the owner of 206 North Main Street for an existing storm lateral entering the City’s property from the rear of the building located at 206 North Main Street. The lateral extends southeasterly approximately 20 feet, connecting to City storm sewer infrastructure located within the parking lot. The history of the lateral is unknown, however, both parties have agreed to formalize the location of the lateral in the proposed easement. The easement will allow the owner and future owners of 206 North Main Street to access, survey, lay, construct, use, operate, maintain, repair, replace, relocate and/or remove storm sewer lateral and appurtenant equipment. The City Attorney’s Office is in the process of drafting necessary easement documents. RECOMMENDATION/CONDITIONS Staff recommends approval of the request to grant a storm sewer lateral easement at 205 State Street to 206 North Main Street.
