ITEM I-C: RECOMMENDATION PERTAINING TO ACQUISITION OF A PARKING
LOT EASEMENT AT 210 NORTH MAIN STREET TO 205 OTTER AVENUE
(200 EAST PARKING LOT)
GENERAL INFORMATION
Applicant: City of Oshkosh Transportation Department
Owner: Jon P. Gruenstern and Armstrong Ventures, LLC
Actions Requested:
The City of Oshkosh Transportation Department is requesting approval to acquire an easement
at the rear of the owners’ property which is currently being used as part of a City-owned public
parking lot. Under Section 62.23 of the Wisconsin Statutes and Chapter 30 of the City’s
Municipal Code, the Plan Commission is responsible to review and advise the Council on the
acquisition of interests in land for public utility purposes. The Council will then, based upon the
recommendation from Plan Commission, make a final determination on whether to acquire the
easements as requested.

Property Location and Background Information:
The 534 square foot subject area is the common
area of Giltedge Office Condominium located east
of the building at 210 North Main Street. During
reconstruction of the City-owned 200 East Parking
Lot, it was discovered that part of the parking lot
crossed the common area of the owners’
condominium property. The origin of the parking
lot’s location is unknown, however, both parties
have agreed to formalize the location of the
parking lot in an easement crossing part of the
owners’ property.

ANALYSIS
The proposed easement is proposed to be
10 feet wide by approximately 27 feet long
and 534 square feet in area. The easement
will allow the City to access, survey, lay,
construct, use, operate, maintain, repair,
replace, relocate and/or remove the
parking lot and appurtenant
improvements and equipment.
The City Attorney’s Office is in the
process of drafting necessary easement
documents.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the request
to acquire a parking lot easement at 210
North Main Street.
