Roll call was taken and a quorum declared present. Mr. Nichols arrived at 4:02 pm. The minutes of February 19, 2025 were approved as presented. (Davey/Scheuermann) I. CONSENT AGENDA: A. RELEASE TEMPORARY CUL-DE-SAC EASEMENT AT 3110 PROGRESS DRIVE B. RECOMMENDATION PERTAINING TO ACQUISITION OF STORM SEWER EASEMENTS AT 3123 JACKSON STREET (ALONG THE NORTH LINE OF FUTURE FERNAU AVENUE) Motion by Propp to adopt the findings and recommendation as stated in the staff reports. Seconded by Davey. Mr. Perry asked if there was any discussion on the motion. There was none. Motion carried 9-0. II. DELETE OFFICIALLY MAPPED PROGRESS DRIVE FROM ITS EXISTING SOUTHERN TERMINUS SOUTHEASTERLY TO VINLAND STREET Site Inspections Report: No one reported visiting the site. Staff report accepted as part of the record. __________________________________ Plan Commission Minutes 2 March 4, 2025 The City of Oshkosh Department of Community Development requests the deletion of Officially Mapped Progress Drive located from its existing south end to Vinland Street. Mr. Nau presented the items and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. Staff recommends approval for the deletion of Officially Mapped Progress Drive as requested. Mr. Perry opened up technical questions to staff. Mr. Kiefer asked if any part of the road would be needed in the future. Mr. Nau stated this section of Progress Drive is not needed. Mr. Loewenstein asked if the area was going to have industrial development. Mr. Nau stated it is industrial. Mr. Perry opened public comment and asked if the applicant wanted to make any statements. City staff did not have any more comments. Mr. Perry asked if any members of the public wished to speak. Kabinga Maini, the Plant General Manager at 3110 Progress Drive in Oshkosh, asked about traffic impact and water runoff. Mr. Nau stated no plans have officially been submitted to the city yet. Any new development would have to meet storm water requirements. Ms. Rutkowski stated there will be more information as the development progresses. Mr. Perry closed public comment. There was no closing statement from the applicant. Motion by Propp to adopt the findings and recommendation as stated in the staff report. Seconded by Scheuermann. Mr. Perry asked if there was any discussion on the motion. There was none. Motion carried 9-0. __________________________________ Plan Commission Minutes 3 March 4, 2025 III. STREET RIGHT-OF-WAY DEDICATION FOR PROGRESS DRIVE (3110 PROGRESS DRIVE) Site Inspections Report: No one reported visiting the site. Staff report accepted as part of the record. The City of Oshkosh Department of Public Works requests right-of-way dedication of a cul-de-sac bulb at the easterly southern terminus of Progress Drive. Mr. Nau presented the items and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. Staff recommends acceptance of the right-of-way dedication for Progress Drive as proposed. Mr. Perry opened up technical questions to staff. There were none. Mr. Perry opened public comment and asked if the applicant wanted to make any statements. City staff did not have any more comments. Mr. Perry asked if any members of the public wished to speak. Kabinga Maini, the Plant General Manager at 3110 Progress Drive in Oshkosh, asked about the driveway and if that is part of the Certified Survey Map (CSM). Mr. Nau stated the driveway is not part of the CSM. There will be a separate site plan review, at a later time, for the driveway connection to the new bulb. Mr. Maini stated he was referring to the driveway into the facility, not the bulb. Mr. Nielsen stated that will be done through a commercial building permit. Mr. Perry closed public comment. RESIDENTIAL DESIGN STANDARDS VARIANCE TO ALLOW FOR A NON- STANDING SEAM METAL ROOF WITH EXPOSED FASTENERS AT 1215 WEST NEW YORK AVENUE Site Inspections Report: Mr. Bowen, Ms. Propp, Mr. Nichols, Ms. Davey, and Mr. Perry reported visiting the site. Staff report accepted as part of the record. Mr. Nielsen presented the items and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. The design standards for residential metal roofs were reviewed. Staff recommends denial of the requested variance from the City’s Residential Design Standards to allow a residential non standing seam metal roof with exposed fasteners at 1215 West New York Avenue with the finding following finding: The roofing material, as installed, does not meet the intent of the ordinance to maintain the basic architectural quality of residences in the community, as corrugated metal with exposed fasteners is of a lower standard than required by code or allowed to be used on other properties. Mr. Perry opened up technical questions to staff. Mr. Nichols asked if anyone has complained about the metal roof on SeeClickFix. Mr. Nielsen stated not that he is aware of. Mr. Nichols wondered if there is a technical reason why the corrugated roof is bad and the standing seam roof is good, other than aesthetics. Mr. Nielsen discussed the research he did. When you have concealed fasteners there are rubber brackets. The screws get put into the metal panel and the rubber seals can deteriorate over time. When you have a standing seam metal roof those are concealed, so they are not in the elements. The other big difference between the two types is a standing seam metal roof panel may move in the bracket, similar to siding, when there are changes in temperature. You can get warping and popping of the screws with the corrugated metal. Mr. Nichols asked if the State requires the City to have people obtain permits and have inspections for new roofs, or is that something the City chooses to do on their own. Mr. Nielsen and Ms. Rutkowski stated they do not know, but it is in the City’s code that a permit is required for roofing. Mr. Nichols asked if staff will continue to support roof permits. Ms. Rutkowski stated there is a code, process, and fee schedule audit being done. As code stands, being able to do inspections and check for safety issues is important and staff is supportive of that. __________________________________ Plan Commission Minutes 5 March 4, 2025 Mr. Nichols asked Mr. Nielsen what his personal opinion is on changing the current code on corrugated roofs, based on his research. Mr. Nielsen stated a workshop could be done again to discuss metal roofs. Based on his research, corrugated metal roofs were not recommended for residential properties. Ms. Scheuermann asked if other communities around us allow these types of roofs. Ms. Rutkowski stated she believes they are allowed but does not know to what extent or standards. Mr. Perry opened public comment and asked if the applicant wanted to make any statements. The applicant/owner was not present. Mr. Perry asked if any members of the public wished to speak. Seconded by Kiefer. Mr. Perry asked if there was any discussion on the motion. Mr. Bowen wondered if Design Standard Variances (DSV) go on to Council. Ms. Rutkowski stated DSVs do not go to Council. Ms. Propp mentioned an extensive workshop was done, years ago, on standing seam metal roofs, and if they should be endorsed or not. At that time, they came up with an excellent ordinance. Mr. Nichols stated these types of items are hard for him to deny, unless there is a really good reason. He thinks we should continue to evaluate the rules and see if they should continue to exist. Mr. Kiefer discussed the analysis and workshop that Ms. Propp brought up. A lot of work was done to come up with the variance. Mr. Nielsen stated in 2021 the Plan Commission denied a variance, relatively similar to this one, but it had to do with thickness not exposed fasteners. Mr. Nichols, Ms. Propp, Mr. Nichols, Ms. Davey and Mr. Perry spoke in support of staff’s recommendation to deny the request. Motion carried 9-0. (The Design Standard Variance request was denied.) __________________________________ Plan Commission Minutes 6 March 4, 2025 V. PUBLIC HEARING: CONDITIONAL USE PERMIT REQUEST FOR NEW APARTMENTS AT 913 AND 923 SOUTH MAIN STREET (PARCELS 0301990000 AND 0301980000) Site Inspections Report: Mr. Loewenstein, Mr. Bowen, Ms. Scheuermann, Ms. Propp, Mr. Nichols, Ms. Davey and Mr. Perry reported visiting the site. Staff report accepted as part of the record. Mr. Nielsen presented the items and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. Staff recommends approval of the proposed Conditional Use Permit for new apartments at 913 and 923 South Main Street as proposed with the findings and conditions listed in the staff report. Mr. Perry opened up technical questions to staff. Mr. Nichols asked what has changed since this item last came to Plan Commission. Mr. Nielsen stated the change is that it now includes 923 South Main Street. Mr. Nichols asked if this is a necessary step before they can apply for tax credits. Mr. Nielsen stated that is his understanding. The applicant/owner could answer that. Ms. Propp asked if the final façade renderings would come to Plan Commission at a later time. Mr. Nielsen stated that is correct. Mr. Perry asked about the number of apartments. He sees thirty-three (33) parking spaces. Mr. Nielsen stated the total number of apartments is forty-seven (47). The next Plan Commission item will discuss the proposed fourteen (14) additional parking spaces, across the street. Mr. Perry opened the public hearing and asked if the applicant wanted to make any statements. Todd Hutchinson, of 2536 Fond du Lac Road in Oshkosh, with Wisconsin Redevelopment discussed going for Wisconsin Housing & Economic Development Authority (WHEDA) tax credits, and if they get them then they will start looking at the design of the building. In order to apply to WHEDA you have to have the zoning in place. He discussed how the proposed project is larger than it was in prior requests/presentations. He was available for any questions. Mr. Perry asked if any members of the public wished to speak. There were none. GENERAL DEVELOPMENT PLAN FOR AN OFF-SITE PARKING LOT AT VACANT PROPERTY LOCATED ON THE SOUTH SIDE OF WEST 10TH AVENUE WEST OF SOUTH MAIN STREET (PARCEL 0302450000) Site Inspections Report: Mr. Loewenstein, Mr. Bowen, Ms. Scheuermann, Ms. Propp, Mr. Nichols, Ms. Davey and Mr. Perry reported visiting the site. Staff report accepted as part of the record. Ms. Dziengeleski presented the items and reviewed the site and surrounding area as well as the land use and zoning classifications in this area. Staff recommends approval of the General Development Plan with the findings listed in the staff report and the proposed following condition: All requested Base Standard Modifications will be addressed as part of the Specific Implementation Plan application.
