ITEM I-B: RECOMMENDATION PERTAINING TO ACQUISITION OF STORM
SEWER EASEMENTS AT 3123 JACKSON STREET (ALONG THE NORTH
LINE OF FUTURE FERNAU AVENUE)
GENERAL INFORMATION
Applicant: City of Oshkosh Department of Public Works
Owner: Robert Thomas Martin Irrevocable Trust/Virginia Tawawili Trust
Actions Requested: The City of Oshkosh Department of Public Works is requesting approval
to acquire three storm sewer easements along the south side of the owner’s property which is
also the proposed north right-of-way line of the Fernau Avenue extension from Vinland Street
to Jackson Street. Under Section 62.23 of the Wisconsin Statutes and Chapter 30 of the City’s
Municipal Code, the Plan Commission is responsible to review and advise the Council on the
acquisition of interests in land for public utility purposes. The Council will then, based upon the
recommendation from Plan Commission, make a final determination on whether to acquire the
easements as requested.

Property Location and Background Information:
The 3.67-acre subject property is a long, narrow property with 126 feet of frontage along the
west side of Jackson Street with a depth
of 1,271 feet. The site is across from the
east intersection of West Fernau Avenue
and Jackson Street, approximately ¼
mile south of Logan Drive. In 1974, the
City officially mapped a ½ mile section
of West Fernau Avenue between
Vinland Street and Jackson Street,
followed by land acquisition in 2006 for
right-of-way purposes. The City is in the
design phase for construction of this
section of Fernau Avenue and is in need
of three storm sewer easements located
on the south side of the subject property.

ANALYSIS
Three easements are being proposed at this location:
Easement 1 – (easternmost) is proposed to be 15.00 feet wide, 20.00 feet deep and 300 square feet
in area. The easement is located approximately 229 feet west of Jackson Street.
Easement 2 – (central) is proposed to be 15.00 feet wide, 30.00 feet deep and 450 square feet in
area. The easement is located approximately 583 feet west of Jackson Street.
Easement 3 – (westernmost) is proposed to be 10.00 feet wide, 25.00 feet deep and 250 square
feet in area. The easement is located approximately 907 feet west of Jackson Street.

The three easements will allow for proper grading and have storm sewer infrastructure
installed, most likely at-grade inlets and piping leading to the West Fernau Avenue right-of-
way. Storm water runoff will collect from the lands to the north, then be conveyed through the
inlets into newly-constructed storm sewer within the West Fernau Avenue right-of-way.
The City Attorney’s Office is in the process of drafting necessary easement documents.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the request to acquire storm sewer easements at 3123 Jackson
Street.
