Performance Elevator Consulting, LLC. (Consultant) proposes to perform elevator Consulting Services, as detailed, for Client of:

Provide elevator modernization consulting services for four Dover Oildraulic passenger
elevators that were installed by my family’s Northwestern Elevator Company in 1994 at the
Oshkosh Public Library and in 1983 at the Oshkosh Public Museum.
Conduct a comprehensive survey of each elevator as a basis to formulate plans,
considering the equipment age, usage, existing finishes, accessibility, and applying
new technology and elevator safety codes.
Identify the related work of other trades to be completed by the Owner’s contractors,
including electrical, fire alarm, and possibly cooling or ventilation of the machine
rooms. We will provide a site specific summary and assist in coordinating this work.
Commission elevator shop drawings of the elevator hoistways and machine rooms
for the benefit of bidders. Drawings will not include key plans. It is stipulated that the
City will provide photocopies of building drawings for reference, if available. A plan
view of the machine room, hoistway and elevator lobby are requested.
Write a single elevator specification (Section 14 24 20) detailing the minimum
requirements for elevator modernization to promote competitive bidding by various
elevator contractors. The 3 part CSI format will be used. Provide a Bid Form.
Include applicable alteration requirements to meet the current ASME A17.1-2016 and
SPS 318 elevator safety codes.
Based on the installation dates, all four underground hydraulic cylinders are the
newer double-bottom type and will be retained unless you request otherwise. Note: if
an underground cylinder subsequently fails it will require an expensive replacement.
Non-proprietary equipment will be specified. The rated speed of the existing
elevators will be evaluated and recommendations made.
Maintenance and callbacks during the installation and warranty periods will also be
addressed by the specification.
Lead a single Pre-bid conference and site inspection of both locations with
prospective bidders that we will identify and invite. Respond to bidder questions.
Assist Client in evaluating bids received and provide an elevator contractor
recommendation best serving the Client’s needs.

Advise Owner during contract negotiations with the selected elevator supplier.
Review the elevator shop drawing and product data submittals and mark up
corrections.
Lead one pre-construction conference to finalize critical scheduling and efficient
coordination of the related work of other trades.
Observe work progress during installation with one site visit per elevator during
installation to ensure conformance with specification requirements.
In addition, provide one pre-inspection audit of each elevator to verify completion of
the related work of other trades, which may affect passing the acceptance inspection.
Perform one post-inspection audit of each elevator to ensure compliance with the
specification. Provide a punch list of non-compliant items.
Review and certify the elevator contractors’ invoices for Client as requested.
Review maintenance manual, wiring diagram, and warranty submittal/closeout
documents.
Price for Consulting Services as detailed ................................................................... $33,368.00
Consultant will deliver the elevator specification, drawings, and a bid form. No project
manual, general conditions, or specifications and drawings for the other trades are included
by Consultant in the scope of services.
Client is to provide copies of building plans of the machine rooms, hoistways, and lobbies.

This agreement when signed by Client and by Performance Elevator Consulting, LLC.,
including the terms and conditions set forth on the back which are incorporated herein and
expressly made a part hereof, shall constitute exclusively the contract between the parties,
and all prior representations or agreements not incorporated herein are superseded.

Terms and Conditions
Client represents that they have legal authority to execute this Proposal.
This Proposal is submitted for acceptance within forty-five (45) days from the date executed by us and
thereafter subject to withdrawal or change without notice.
Consultant warrants that it has the experience and ability to perform the Consulting Services, as
contemplated by this Proposal, and that it will perform the Consulting Services in a professional and
competent manner, and makes no other representations and warranties, whether expressed or implied.
Consultant is not a Professional Engineer.
You agree to provide access to the equipment, and to provide pertinent information, inspection reports,
and maintenance records requested to carry out the assessment review. No liability for the use,
operation, management or control of the equipment is assumed by Performance Elevator Consulting,
LLC.
It is stipulated that Consultant is an independent contractor and shall not be treated as an employee of
Client for State and Federal tax or for any other purpose.
Client agrees to pay Performance Elevator Consulting, LLC. progress payments submitted on
approximately a monthly basis. 100% of payments are due within 30 days after DSPS or Agency
inspection.
Client agrees to pay Performance Elevator Consulting, LLC. within thirty (30) days after date of each
invoice. If timely payment is not made, Consultant shall be entitled to a service charge of 1.5% per
month on all past due amounts, plus all costs of collection, including reasonable attorney’s fees.
