A quorum was determined to be present. APPROVAL OF MINUTES Motion by Hudak for approval of the July 8, 2024 minutes. Seconded by Floam. Motion carried 5-0. ELECTION OF OFFICIALS Motion by Millette to nominate Amy Davis as Advisory Park Board Chairperson. Seconded by Franz. Motion carried 5-0. Motion by Herman to nominate Lester Millette as Advisory Park Board Vice-Chairperson. Seconded by Metz. Motion carried 5-0. OLD BUSINESS 1) DISCUSS AND RECOMMEND THE COMPREHENSIVE OUTDOOR RECREATION PLAN (CORP) UPDATE Mr. Maurer stated that the CORP is a document that requires updating every 5 years to maintain DNR grant funding. John Kneer and Rebecca Ramirez with Rettler Corporation are present to discuss the details of that document. Kneer reviews what a Comprehensive Outdoor Recreation Plan is and the process taken to obtain the data used to compile an updated plan. His presentation covers brief overview each of the 8 sections within the plan. I. Introduction: Includes past planning and accomplishments, goals and objectives, AVISORY PARK BOARD MINUTES PAGE 2 APRIL, 8, 2024 and planning processes. II. Community Description: Includes demographics, environmental characteristics, history, locations, and current land uses. III. Parkland Inventory: Highlights general descriptions and park classifications, maps outdoor recreation areas and parklands, and provides a parks amenity matrix. IV. Parkland Analysis: Compares the City of Oshkosh to the recommendations of the NRPA. V. Needs Assessment: Includes the Polco Survey conducted in March of 2024 taken by 483 participants, community input meetings, and staff input meetings. VI. Recommendations: Includes general recommendations, park-site specific recommendations, proposed park types, and maintenance recommendations. VII. Implementation Strategies: Includes proposed capital improvement prioritization, the potential for impact fees, and updated parkland dedication fee recommendation. VIII. References Mr. Maurer references the 6 park master plans that have been developed independently but are referred to in the CORP. Additionally, the City of Oshkosh Americans with Disabilities Act Transition Plan for Public Buildings and Facilities and City of Oshkosh Assessment of Municipal Parking Lots. Motion by Floam for recommendation to adopt the Comprehensive Outdoor Recreation Plan (CORP), with the addition of a neighborhood park south of 9th street, to the Plan Commission and Common Council. Seconded by Millette. Motion carried 5-0 STAFF REPORTS PARKS DIRECTOR (Maurer) Mr. Maurer stated that a resident from the Riverwatch Condo Association near the Stieger Boat Launch has contacted the City requesting the consideration of extending the Slow No Wake Zone for the Fox River between the Oshkosh Avenue bridge and Wisconsin Street bridge. This will be brought back to the Advisory Park Board in September where public comment will be welcomed. ASSISTANT DIRECTOR (Dallman) Mr. Dallman stated the Memorial Bench Program is still in review but the department is currently working to install 5 benches from previous orders. Numerous supply chain issues have been encountered over the last year while trying to obtain materials. Mr. Dallman stated that the construction of bear and fox exhibit at the Menominee Park Zoo is complete. The department is still working to locate black bears but has recently welcomed two male foxes to the zoo. Rusch Park Trail, between Newport Avenue and Ruschfield Drive will be under construction for a period of 1-2 weeks while an overlay and reconstruction is completed. With the help of the Streets Department, the last section of trail at South Park will also be competed. A public notice has been posted at both locations. LANDSCAPE OPERATIONS MANAGER (Derks) Mr. Derks stated the HWY 44 center island landscape work has been competed. This was part of a larger project that is set begin in September and will include several city- maintained round-a-bout locations. ADJOURNMENT Motion by Franz for adjournment; seconded by Herman. The meeting adjourned at 6:50 P.M Respectfully submitted, Ericka Maertz Administrative Assistant TO:TO:Advisory Parks Board FROM:FROM:Ray Maurer DATE:DATE:September 09, 2024 SUBJECT:SUBJECT:Discuss and recommend extension of the no wake zone between the Oshkosh Avenue bridge and Wisconsin Street bridge BACKGROUNDBACKGROUND At its meeting on Monday, September 9, 2024, the Advisory Park Board will discuss a request to extend the no wake zone in the Fox River. Section 30.77 of the Wisconsin Statutes authorizes the City of Oshkosh to enact ordinances applicable on the waters of the State that lie within its jurisdiction. Such regulations are specifically authorized to include restrictions on speed. There is currently established a No Wake Zone within the Fox River in and around the Oshkosh/Congress Avenue Bridge in the municipal code. SECTION 17-29 _ SPEED LIMITS FOR MOTORBOATS A. No person shall drive or operate a motorboat at a speed in excess of slow-no-wake speed on the following waterways: 1. Fox River, from a point 900 feet south of the Canadian National Railroad bridge north- northwesterly to a point under or through the Oregon/Jackson Street bridge; under or through the Wisconsin/Ohio Street bridge, under or through the Oshkosh/Congress Avenue bridge from a point 1,600 feet south/downstream to a point 1,900 feet north/upstream of the bridge. The city has received a request from the Riverwatch Condominium Association, located at 240 N. Campbell Road, to extend the no wake zone in the Fox River to encompass the entire river between the Oshkosh Avenue bridge to the Wisconsin Street bridge. The request is being made due to reported erosion along their shoreline property. This matter will be considered by the Advisory Parks Board at the meeting and ultimately the Common Council will make a final decision on the request at an upcoming meeting. By statute, the Common Council is required to take into account certain factors when considering whether to exercise its authority to enact ordinances applicable on any waters of the State of Wisconsin. These factors are: 1. The type, size, shape and depth of the body of water and any features of special environmental significance that the body of water has. 2. The amount, type and speed of boating traffic on the body of water and boating safety and congestion; and 3. The degree to which the boating traffic on the body of water affects other recreational uses and the public's health, safety and welfare, including the public's interest in preserving the state's natural resources. After consideration of these factors, the Common Council will ultimately determine whether or not to extend the no wake zone as requested. If approved, the placement of additional navigational aides or buoys would be required and the Wisconsin Administrative Code requires that application be made to the Department of Natural Resources (DNR) for approval of the proposed placements of these. City staff would make the appropriate application to the DNR. Included in your packet is correspondence from individuals opposed to the no wake extension. Mr. Ray Maurer Access to water, without “no wake” limitations is very important to Mercury Marine. We believe our use of the Fox River, Lake Bute des Mortes and Lake Winnebago, important as it is both reasonable and low impact to the average recreational boater. Mercury Marine believe that the limited imposition that our use of the water places on the waterway is more than made up for by our support of others that use the water, and through our involvement in the community. As a result, we request that the petition to establish the requested “no wake” zone be denied. This data is internal to Brunswick. Ray, Just want to chime in on the request to extend the no wake zone from Spellmann's to the Wisconsin St bridge. We are against extending the no wake zone for the following reasons: * Most of our boaters would be very inconvenienced with such a long no wake zone that would make travel between lakes take even longer. This would include fishermen involved in local fishing tournaments (who make very little wake while traveling quite fast). Recreation along the Fox River is vital to our local economy, and another no wake zone would simply tell boaters that they are not valued. * Shoreline landowners complaining about river traffic is a bit like buying a house near an airport or pig farm, and then complaining about the noise or smell. Condo owners knew of the river traffic when they purchased their property. Furthermore, their shoreline is likely to deteriorate even with a no wake zone, as wake from boats is not the only factor in wear and tear. * Several businesses would be negatively affected by an extended no wake zone. Mercury, Fox Harbor Marina (watercraft rentals), Kubasta's Landing, LLC, and other marinas have boaters that want to get up and go to their destination without extending no wake zones. * The real problem is not the average boater zipping along this section of the river while on plane (leveled out). I'd estimate that about 90+% of the boats on the river have no effect on the shoreline, despite their speed. The problem of wake comes from the very large boats cruising with their bow up and plowing through the water, as well as the wakeboard boats continually going back and forth with boats designed to make very large wake. These two types of boaters are almost exclusively the ones causing safety issues with surrounding small craft (kayaks, canoes, anchored fishing boats), and seemingly unconcerned about launching boaters at the public launch and our two hoists, and also causing some of the shoreline erosion. The only wake that comes up over the shore is from the very large boats cruising bow up, and the wakeboard boats. Perhaps we can have a discussion with the Sheriff's Dept about how they could enforce safety concerns over the very large wake and inconsiderate driving rather than worrying about the speed of boats or those on plane. Is there a way to consider changing the laws along the river to prevent "plowing" (especially during high water), and preventing wakeboarding in the river? Please bring these points up with your colleagues, but I am also willing to come to the Sept. 9th council meeting if needed. Thanks for your consideration, John Kubasta 920-376-6071 cell/text Manager Kubasta's Landing, LLC Visit our website TO:TO:Advisory Parks Board FROM:FROM:Ray Maurer DATE:DATE:September 09, 2024 SUBJECT:SUBJECT:Discuss and recommend 2025 fees for Pollock Community Water Park BACKGROUNDBACKGROUND As part of the annual departmental review of fees, staff is recommending an increase in various fees for Pollock Community Water Park in 2025. In 2020 the daily admission fees were increased slightly; in 2022 the season pass fees and daily admission fees were increased. The proposed increase in fees is necessary to help offset pool staffing costs to remain competitive with the market, as well as increased operating costs. We surveyed eight other area municipal pools, reviewing information and comparing fees from 2024. Please see the attached document for that information. Also attached are the proposed fees for 2025; staff is also recommending elimination of the reduced evening fee after 5PM. Based on the past three-year average for each category of fees, the total estimated increase in revenue with these increases would be approximately $20,000 - $25,000.
