Dear Mr . Pawlacyk :
Upon my inspection of 122 and 126 W. 16th ave. on November 6 , 19go
I found that the portion of the garage slab on 122 W. 16th Ave .
had not been removed yet. You stated that my previous letter
dated October 24 , 19g0 had only referenced 126 W. 16th Ave., not
both addresses . At this time I am informing you that both
properties must be brought into compliance with the requirements
stated in the aforementioned letter .
If you desire to build a shed on a portion of this slab I would
advise you to submit a detailed site plan showing the location of
the slab you wish to use , the location of the shed and obtain a
Building Permit by November 15 , 1990 .
I had rescheduled a final inspection for November 8, 1990 (30 days
after your conference with the City Manager) . In light of your
desire to keep a portion of the slab , I will delay my final
inspection until November 16 , 1g90 to allow you ample time to
either obtain a Building Permit for a shed or remove the remainder
of the slab .
Enclosed is a copy of my October 2�4, 1990 letter detailing setback
requirements for open slabs .

Dear Mr. Pawlacyk:
You have asked for a Zoning Ordinance clarification in regard to the
remaining concrete garage slab which was part of a garage structure
and straddled the lot line at the above referenced location. Your
specific question per your correspondence is why does the concrete
slab need to be removed?
Section 30-1 (A) 135 Definitions of the City of Oshkosh Zoning Ordinance
defines a structure as: Anything constructed or erected, the use of
which requires permanent or temporary location on the ground; includ-
ing, but without limiting the generality of the foregoing, advertising
signs, billboards, backstops for tennis courts, pergolas and fences.
As such, the remaining concrete slab is defined by the Zoning
Ordinance as a structure and is required to meet all applicable stand-
ards for a structure.
The specific zoning violations have been identified by the Violation/
Correction Notice you received. (I have enclosed copies of this
correspondence for your information. ) These identified standards
apply to the remaining concrete garage slab. As a result, the con-
crete garage slab which is defined as a structure must be addressed in
the same manner as the garage and must be removed.
If the appropriate setbacks are met, it may be possible to retain a
portion of the slab. The setback standards which apply in this case
are as follows:
25. ft. front yard setback;
25 ft. rear yard setback
7 1/2 ft. side yard setback.

If it is your intent to retain a portion of the slab in question,
meeting the appropriate setbacks, you will need to immediately inform
this office of your intent. If not, compliance with the Zoning Ordi-
nance will need to be accomplished within the agreed upon time frame.
