Box 1130 Oshkosh, WI 54903-1130 Attention: David Patek, DPW Re: Agreement for Planning Services Pearl Avenue Transportation Study This is an Agreement between the City of Oshkosh, hereinafter referred to as OWNER, and Strand Associates, Inc., hereinafter referred to as ENGINEER, to provide planning services (Services) related to the Pearl Avenue Corridor from N. Main Street to W. Murdoch Avenue. This Agreement shall be in accordance with the following Scope of Services, Compensation, Payment, Schedule, and other General Conditions contained herein. Scope of Services A. Collect Information I. Perform PM peak tuming movement counts at key intersections a. Main Street! Algoma Boulevard b. Main Street/High Avenue c. Main StreetlPearl Avenue d. Algoma Boulevard/High Avenue Collect existing plat maps/right-of-way Create a photo log of affected streets 2. 3. B. Construct traffic operations computer model and evaluate traffic operations I. Create existing network traffic volume schematic (P.M. peak) 2. Create proposed network traffic volume schematic (P.M. peak) 3. Create a Synchro model of the existing network 4. Create a Synchro model of the proposed street network C. Develop roadway concepts I. Typical sections for Pearl Avenue a. Block I (East) b. Block 2 (Middle) c. Block 3 (West) Develop needed intersection configurations a. Main StreetlPe¡¡¡:l,.Ayenue b. Pearl Avenue~~"Street c. PearlAvenue/High Avenue d. Document findings in a draft and final report ENGINEER will attend two coordination meetings with the OWNER during the alternatives development. These planning services do not include meetings with the University, affected landowners, or the public. Compensation The Services performed under this Agreement shall be provided for a lump sum fee of $34,850. The fee assumes there will be no significant delays, extensions, amendments, or changes in the Scope of Services. Payment OWNER shall make monthly payments to ENGINEER for Services performed in the preceding month based upon monthly statements. Nonpayment 30 days after the date of receipt of invoice may, at ENGINEER's option, result in assessment of a I percent per month carrying charge on the unpaid balance. I '1.coS Termination This Agreement may be terminated with cause in whole or in part in writing by either party subject to a two-week notice and the right ofthe party being terminated to meet and discuss the termination before the termination takes place. ENGINEER shall be paid for all completed or obligated Services up to the date of termination. Remedies Except as may be otherwise provided in this Agreement, all claims, counterclaims, disputes, and other matters in question between OWNER and ENGINEER arising out of or relating to this Agreement or the breach thereof shall be decided by mediation. Box 1130 Oshkosh,WI54903-1130 Re: Pearl Avenue Transportation Study Dear Mr. Patek, This letter acknowledges and confirms that UW Oshkosh will provide partial funding in the amount of $17,425 for the Pearl Avenue Transportation Study. I understand that the Department of Public Works will administer the agreernent with the engineering firm and send an invoice at the completion of the study.
