INITIATED BY:

PLAN COMMISSION RECOMMENDATION: Approved w/conditions
BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit within an existing planned development to allow placement of
communication antennas on the rooftop of Nelson Hall at 736 Algoma Boulevard within
the UW-Oshkosh campus, per the attached, is hereby approved with the following
conditions:
Service equipment for the antennas is prohibited from locating on the roof.
1 )
2)
A base standard modification is granted per Section 30-35(J)(4) of the Zoning
Ordinance to allow antenna placement in a residential zoning district.
3)
Antennas are to be removed when no longer used to provide wireless service.
BE IT FURTHER RESOLVED that the Common Council of the City of Oshkosh
hereby approves of the Planned District Overlay and final development plan per the
attached.

NIER Compliance of proposed Alltel rooftop colocation
Dear Mr. Burich:
In accordance with the city's application requirements, please be advised that the site
proposed above will conform to current FCC standards for non-ionizing electromagnetic
radiation (NIER).
Alltel's radio and telecommunications equipment and will not interfere with other cellular
carriers or other existing radio frequency bandwidths in the area including garage door
openers and all other similar radio equipment. Alltel will be operating within the strict
requirements of their FCC license.
Should such interference be discovered, Alltel will immediately correct the problem.
Additionally, it is Alltel's policy to comply with all applicable codes, laws, rules and
regulations of any governing body or agency having jurisdiction over such uses.

COVERAGE OBJECTIVE & STATEMENT OF PURPOSE
Dear Mr. Burich:
Your office requests a statement indicating Alltel's coverage objective and purpose for the
proposed rooftop telecommunications facility at the above-referenced site,
As you might already be aware, cellular providers are required to provide personal wireless
service as part of their license requirements and failure to do so would be a violation of the
license awarded by the FCC.
Alltel's radio frequency ("RF") engineers have identified the need to provide service
coverage in this target area requiring construction of a new telecommunications facility to
improve mobile coverage for the university campus and downtown Oshkosh.
In short, this is a "capacitv site" needed to off-load sector 2 of the nearbv Oshkosh DT site
which is currentlv over-capacitv (over burdened) with cellular traffic. Locating these
antennas as close to the middle of the dormitories as possible will best meet Alltel's
coverage objectives and enable Alltel to meet their license obligations.
Please be assured Alltel fully intends to cooperate with all carriers who might submit a
collocation application for space on the above-referenced tower. Additionally, it is Alltel's
policy to comply with all applicable codes, laws, rules and regulations of any governing body
or agency having jurisdiction over such uses.
