Billed time will commence 30 minutes prior to the start of the standby and end 30 minutes after termination of the standby. Any additional hours or additional units requested or required in the opinion of the Duty Chief to provide adequate service shall be billed to Life Promotions at the cost recovery rate. Billing for cost of the standby will be completed immediately following the event, payment will be within 7 days of billing. All patients requiring transport by the Oshkosh Fire Department ambulance will be billed for services rendered according to the City's usual and customary procedures and rates for service. PARAMEDIC AMBULANCE STAND-BY 2004 LIFEFEST, JULY 9 & 10,2004. THIS AGREEMENT made and entered into this #4~ay of ~{fl "V , 2004, by and betWeen Life Promotions, Inc., c/o J. D. Smith, 625 E. Cty. Rd. ~sh, WI 54901 hereinafter called "Life Promotions", and the City of Oshkosh, a municipal corporation, hereinafter called "City". WHEREAS, Life Promotions has requested the City provide a dedicated paramedic ambulance services for staIld-by, during specified hours of the Lifefest Event, and WHEREAS, the Common Council for the City of Oshkosh has authorized the appropriate City officials to enter into such an agreement. NOW, THEREFORE, it is agreed by and betWeen the parties to this agreement that the City shall provide one (1) tWo-person paramedic ambulance to be present at the Winnebago County Fair- grounds during the Lifefest Event on: Friday, July 9, 2004 from 6:00 p.m. to 12:00 a.m. and Saturday, July 10, 2004 from 6:00 p.m. to 12:00 a.m. The role of these units shall be to provide Basic Life Support (BLS) aIld Advance Life Support (ALS) for emergencies, if they occur. Life Promotions shall indenmify and save harmless the City from and against any and all losses, claims, demands, penalties, fines, causes of action, costs, damages, expenses and liability, including without limitation any attorney or consultant fees, investigation fees, court costs and litigation expenses, and other costs of defense arising out of or in aIlY manner related to Life Promotions's operation of the Lifefest Event, including but not limited to: A. Any personal injury or bodily injury (including wrongful death) or property damage (real or personal); B. Any lawsuit brought or threatened, settlement reached, or local, state, or federal government or agency order, including, but not limited to claims, costs, liabilities, or expenses arising under federal, state, or local law; -; '-.. .-!~~ C. Any violation of laws, orders, regulations, requirements, or demands of any governmental authorities; and, D. Any breach or violation of any contracmal provision of whatever kind with aIlY third party.
