WHEREAS, the City of Oshkosh has constructed a parking lot on the hereafter described property located on the northeast corner of Division Street and Church Avenue in the City of Oshkosh, Winnebago County, Wisconsin; and and WHEREAS, Grantee has conveyed certain lands owned by Grantee to Grantor; WHEREAS, as part of the consideration for said transaction Grantor has agreed to convey an easement over said parking lot to the real estate retained by Grantee. Grantor's premises: That part of Lots 49,51,25,26,27,28 and 29 in Block 43 per Leach's Map of 1894 in the 7th Ward, City of Oshkosh, Winnebago County, Wisconsin, now owned by the City of Oshkosh and on which the above referred to parking lot now exists. Grantee's premises: The North 10 feet of Lot 5 and all of Lot 6 of Block 43 in HENNING'S PLAT Lot 2, Block 43 in the 7th Ward, City of Oshkosh and that part of the North 10 feet of Lot 28 and all of Lot 29 of Block 43 in HENNING'S PLAT Lot 2, Block 43 in the 7th Ward, City of Oshkosh which lie east of a line drawn parallel with and 15' distant easterly from the Center line of The Milwaukee and Lake Winnebago Railroad, as the same was located and operated over and across the Westerly portion of said Lots, except that portion conveyed to the City of Oshkosh pursuant to the description attached hereto. Grantor hereby grants to Grantee an easement over the above-described parking lot and over those portions designed for the travel of vehicles' and not those portions designed for the parking of vehicles for Grantee, Grantee's tenants, servant's visitors and licensees in common with all others having the like right including those others using said premises as a parking lot. Said easement shall at all times hereafter be with or without vehicles of any description for all purposes connected with the use and enjoyment of the land of Grantee as herein described to pass and repass along said easement for the purpose of going from both Division Street and Church Avenue to the real estate above described as owned by Grantee or vice versa. To have and to hold the easement or right-of-way hereby granted unto the Grantee, Grantee's heirs, successors and assigns as appurtenant to the above- described land of Grantee. This easement shall inure to and be binding upon the heirs, successors and assigns of Grantor and Grantee and shall run with the land.
