TRAINING Whereas, the City of Oshkosh and Fox Valley Technical College acknowledge a publíc interest in the education of políce officers for the benefit of students and the community; and Whereas, Fox Valley Technical College has established a program for Basic S.WAT. Training in order to achieve these objectives; and Whereas, the City of Oshkosh has property available for the conduct of training and is willing to make that property available to Fox Valley Technical College for that purpose. The City of Oshkosh, by its authorized representative, and Fox Valley Technical College, by its authorized representatives agree as follows: That the City of Oshkosh hereby authorizes the Fox Valley Technical College, its employees, and duly authorized agents to conduct Basic S.WAT Training on the date and upon the Property specified below: 15 w 7th and 913 Oregon st the week of March 22-26,2004 located within the City of Oshkosh, Winnebago County, Wisconsin Fox Valley Technical College shall be allowed full use and enjoyment of the premises upon the date above-specified. and shall not be liable for any damages caused to the property or buildings thereon during the course of the training exercises. Provided however, that Fox Valley Technical College shall not and shall not permit others to remove stairways, handrails, or other structural supports, the removal of which may render the structure unsafe. During the conduct of the exercises, Fox Valley Technical College shall provide appropriate measures to secure the property. Should the property be damaged and require additional measures to secure upon the completion of the exercises Fox Valley Technical College shall be responsible for providing appropriate measures to secure the property and shall promptly notify the City of Oshkosh by contacting Susan Kepplinger, Principal Planner at 236-5055. Fox Valley Technical College shall be responsible for cleanup of the property following the conduct of training. In consideration of the City of Oshkosh providing a location for training, Fox Valley Technical College shall hold the City of OshKosh harmless for any injury to staff or students occurring during the instructional process and shall maintain all required workers compensation and employee insurance required or otherwise provided to Fox Valley Technical College employees. This shall include all claims, demands, losses, costs, damages and expenses of e.ve.ry kind and description (including death), and/or damage to persons or property arising out of or in conjunction with the training. Fox Valley Technical College shall provide to the City of Oshkosh a copy of their liability insurance endorsement prior to the training exercise. This paragraph is to be liberally construed in favor of the City of Oshkosh, its employees, and authorized agents, in consideration of the provision of a site for training purposes.
