TRAINING Whereas, the City of Oshkosh and the City of Fond du lac acknowledge a public interest in the education of police officers for the benefit of students and the community; and Whereas, the City of Oshkosh has property available for the conduct of training and is willing to make that property available to Fond du lac PO for that purpose. The City of Oshkosh, by its authorized representative, and the City of Fond du lac, by its authorized representatives agree as follows: That the City of Oshkosh hereby authorizes the City of Fond du lac, its employees, and duly authorized agents to conduct SWAT. Training on the date and upon the Property specified below: March 18, 2004 at 15 W 7th ave located within the City of Oshkosh, Winnebago County, Wisconsin Fond du lac shall be allowed full use and enjoyment of the premises upon the date above-specified, and shall not be liable for any damages caused to the property or buildings thereon during the course of the training exercises. Provided however, that Fond du lac PO shall not and shall not permit others to remove stairways, handrails, or other structural supports, the removal of which may render the structure unsafe. During the conduct of the exercises, Fond du lac PO shall provide appropriate measures to secure the property. Should the property be damaged and require additional measures to secure upon the completion of the exercises Fond du lac PO shall be responsible for providing appropriate measures to secure the property and shall promptly notify the City of Oshkosh by contacting Susan Kepplinger, Principal Planner at 236-5055. Fond du lac PO shall be responsible for cleanup of the property following the conduct of training. In consideration of the City of Oshkosh providing a location for training, Fond du lac PO shall hold the City of Oshkosh harmless for any injury to staff or students occurring during the instructional process and shall maintain all required workers compensation and employee insurance required or otherwise provided to employees. The city of Fond du lac shall hold harmless the City of Oshkosh for any and all claims arising from the acts or omissions of students or employees in training occurring during or related to the SWAT. training conducted pursuant to this agreement. This shall include all claims, demands, losses, costs, damages and expenses of every kind and description (including death), and/or damage to persons or property arising out of or in conjunction with the training. This paragraph is to be liberally construed in favor of the City of Oshkosh, its employees, and authorized agents, in consideration of the provision of a site for training purposes.
