Ms. Nieforth said that this is service to their specific buildings. Staff has been working
with the developers and WPS to prepare for the eventual ownership to Mill on Main
and to make sure that they find the terms of the easement acceptable. This is going to
service all the different phases and get them ready to start construction.
Ms. Panek asked if this is close to where the parking lot is.
Ms. Nieforth said that it is on the east side near lot 1 and lot 2, where it curves towards
Pioneer Drive. That’s where the city parking lot will be located. The city engineers are
working on the design of that and it will be added with one of the contracts for 2024.

Discussion on RDA Land Option Terms
Ms. Nieforth said there are quite a few different options or an approved offer to purchase
including infill residential, commercial and multi-family. They are all RDA properties so
a developer could ask for an option for an offer to purchase and then an agreement is
entered with the developer and RDA gives the terms. Some of these properties are just
sitting. For example, the former railroad right of way that had some issues with ATC and
we’re working through that. None of these properties have been sold yet, but if the
developers aren’t going to develop than maybe there could be an alternative.
Mr. Zarate said that in summer of 2023, there had been multiple offers to purchase and it
was brought to the RDA board to decide who gets what lot. They are currently working
on other lots but have said that they want to keep these current lots, but want to see how
it goes. They are also looking into the New Homes in Our Neighborhood Grant program
through the city.
Ms. Nieforth said that the grant program only allows one per year, so instead of working
on multiple projects at once, they are completing them one at a time. For the other lots,
they are just staying vacant. There haven’t been a lot of interest in building on these
currently. Looking forward, it is something that we can pay more attention to before
going forward with the agreements.
Mr. Zarate said that there was discussion on adding a timeline into the agreements
because maybe someone else does want to purchase.
Mr. Belter asked if there was some angst from those who weren’t chosen to purchase lots.
Ms. Nieforth said that each developer was chosen for different lots.
Ms. Panek asked if the build was required to be done in the same year in order to get the
grant money from New Homes in Our Neighborhood.
Mr. Lyons said that the home must be completely done in order to be awarded the grant.
This includes driveway and a seeded lawn. They can only do one a year because the
program is only funded between $50-75,000 per year.

Ms. Nieforth said that these were not signed offers, but option to purchase.
Ms. Nieforth said that Boatworks has been going through the approval process.
Technically, the option to purchase has expired, but they are making good faith effort
and submitting site plans and have gone through the zoning process. They had
mentioned they want to start the building process this spring. They had also requested
TIF assistance, but there have been no requested terms after the council meeting. The
sanitation garage is still up on the western property. They want to remove the building
before entering phase 2. Ms. Nieforth asked how long should the options stay open, of if
they should be required to come in to request a formal extension. Staff does use their best
judgement and if they are making an effort, but at what point does RDA members want
to talk to these developers.
Ms. Nieforth said that The Mill on Main project has been approved for TIF assistance and
they plan on starting construction in March of 2024.
Ms. Panek stated that there could be no way of knowing who is interested in these
properties if the website says there is an offer pending.
Ms. Nieforth said that the infill residential lots can be a niche market.
Mr. Belter asked where the funding comes from for the New Homes in Our
Neighborhood program.
Mr. Lyons said it comes from the Healthy Neighborhoods Initiative.
Mr. Belter asked if there is any additional funding available.
Ms. Nieforth said there isn’t, but if they have a home buyer interested, they could possibly
use the Community Development Block Grant program Home Buyers Assistance.
Ms. Panek asked if Habitat for Humanity uses these programs.
Ms. Nieforth said that they do, and they are currently building some homes on Grove
Street.

Mr. Belter said that he thinks there should be a timeline on these offers to purchase in
case there are other developers who want to build and will do it in a better time frame.
Mr. Hutchinson said there could be some benchmarks to follow within a certain amount
of time.
Ms. Nieforth said there are checks and balances in place, but it could be something to
consider going forward.
Mr. Belter asked if they would be able to look at the financing to see what contingencies
are in place.
Ms. Nieforth said that to a certain extent yes, but sometimes it’s too early in the process.
Ms. Panek said that if these lots aren’t seeing movement by summer, RDA should call
them in for a discussion.
Ms. Nieforth said that the next two meetings are in March and May, so they could work
with that timeline.
Mr. Hutchinson said that movement could include updated plans, or a financing
proposal that is ready to go and potentially close by a certain date.
Mr. Belter said that each project could be looked at individually depending on the scope
of the work and a timeline could be determined then.
Ms. Nieforth said that it just seems like too many lots are stalled.
Mr. Belter said that constriction costs and supply chain are going to restrict movement of
projects.
Mayor Mugerauer said that before the March meeting, maybe staff could check in with
these developers and see where they are in their project timeline to give RDA am update.

Executive Director Report
Ms. Nieforth said that Gallery Homes is working on the Wisconsin Street house and it is
coming along nicely. The garage has been constructed with Accessory Dwelling Units
in the upper floor.
The plans for ThedaCare/Froedtert project has approved plans. Staff is working with
the developers to get started soon for a proposed opening in 2025.
The West 8th Avenue that’s between 7th and 8th Avenue, had a lot of interest. We
requested those interested to submit their information and then nobody submitted.
The South Main Street reconstruction has always been talked about that city staff would
be widening the street in order to add a terrace and to allow on street parking. It’s apart
of the Connecting Highways Program, there has been discussion with the DOT. They
have indicated they will only pay for the rehab construction of what actually needs to
be updated. City staff would still like to make this area pedestrian friendly, so there will
need to be discussion on how to make it work. This project isn’t planned until probably
early 2030’s.
Staff has been working with Merge in relation to the property on the corner of Jackson
and Marion. The plan was to do mixed-use on the east side of the property. They are
struggling to put together a successful building in relation to the bridge construction
that will take place is 2028/2029. Staff is working with them to amend their TIF
development agreement. They also own the parcel south of the water tower. They
originally wanted to do townhomes in that area, but now is looking at different options.
Merge does own these outright, but staff is going to push for mixed-use.
Mayor Mugerauer asked why they’re having issues with the new bridge coming in
because their development ends at the sidewalk. Staff is working with them to come up
with different ideas.
Ms. Nieforth said they mentioned with the approach starting at Marion, there will be a
wall right there.

BE IT RESOLVED by the Redevelopment Authority of the City of Oshkosh that
the offer to purchase in the amount of $13,000.00 submitted by Vienola Properties LLC
for the property located at parcel number 016700710000 (formerly 1429 Fox Street), is
hereby accepted and the proper officials are hereby authorized and directed to execute
any and all documents necessary for purposes of same.
BE IT FURTHER RESOLVED that the terms of said option to purchase

BACKGROUND
The Redevelopment Authority (RDA) acquired the parcel (016700710000) as a donation from the
previous owner in October of 2023 after the owner demolished their home per requirements
from their insurance due to a house fire. The value of the property at the time was $14,700.00.
The city paid the outstanding street assessments and closing costs totaling $5,735.48 using funds
from RDA and paid the 2023 tax bill of $1,968.45. Once the RDA owned the home, the parcel
was added to the RDA’s list of infill lots for sale in the City.
ANALYSIS
Vienola Properties LLC submitted an Offer to Purchase to the RDA for consideration. The
developer followed the RDA’s requirements of submitting the necessary materials for city staff
and RDA members to review for consideration. The developer is proposing to construct a 1,220
sq ft single family home with an attached garage. The home will be constructed slab on grade
due to the proximity to the floodplain.
FISCAL IMPACT
Vienola Properties LLC is proposing to pay $13,000 which is more than the RDA has invested
in the property at this point and is near the assessed value.
RECOMMENDATION
The Redevelopment Authority approves the offer to purchase 1429 Fox Street from Vienola
Properties LLC for $13,000.00

pursuant to Section 66.1333(2m)(b), Wisconsin Statutes, in need of blight elimination, slum

boundary modification known as Amendment #3 to the South Shore Redevelopment Area

of Oshkosh that the area described in the attached "Exhibit A" is blighted and in need of
blight elimination, slum clearance, and urban renewal and redevelopment.
BE IT FURTHER RESOLVED by the Redevelopment Authority of the City of
Oshkosh that Amendment #3 to the South Shore Redevelopment Area Project Plan is
feasible and in conformity with the Comprehensive Plan of the City of Oshkosh.

BACKGROUND
The Redevelopment Authority is required to hold a Public Hearing related to the adoption or
amendment of Redevelopment Area Project Plans. We are currently proposing to amend the
existing South Shore Redevelopment Area boundary to remove parcels that overlap with the
newly proposed Sawdust District Redevelopment Area. Staff held an open house on the
proposed Redevelopment Plan on March 6, 2024 with approximately 30 people in attendance.
ANALYSIS
With the success of the Marion Road Redevelopment Area, the City has identified the Sawdust
District as the next redevelopment area that the City will focus our efforts to redevelop along
the waterfront and surrounding areas. While evaluating the boundaries for the potential new
district, staff determined the best practice would be for the redevelopment area boundary to
match the area of the previously approved Sawdust District Master Plan. That plan was
approved in 2020 and in an effort maintain consistency and build off the adopted master plan,
it makes the most sense to keep consistent boundaries. However, in doing so, some parcel in
the northern portion of the Sawdust boundary overlapped with the previous South Shore
Redevelopment Area boundary and since Redevelopment Area boundaries cannot overlap, we
are recommending a modification to the Redevelopment Area.
RECOMMENDATION
The Redevelopment Authority recommends approval of Modification #3 to the South Shore
Redevelopment Area.

WHEREAS, the area described in the attached "Exhibit A" is a blighted area
pursuant to Section 66.1333(2m)(b), Wisconsin Statutes, in need of blight elimination, slum
clearance, and urban renewal and redevelopment and in need of redevelopment; and
WHEREAS, the Redevelopment Authority of the City of Oshkosh has prepared a
comprehensive redevelopment plan known as the Sawdust District Redevelopment Area
Plan which contains:
1) a statement of the boundaries of the project area; and
2) a map showing existing uses and conditions of real property; and
3) a land use plan showing proposed uses of the area; and
4) information showing the standards of population density, land coverage, and
building intensity in the area after redevelopment; and
5) information regarding the present and potential equalized value for property
tax purposes; and
6) a statement of proposed changes in the zoning ordinance or maps and
building codes and ordinances; and
7) a statement as to the kind and number of site improvements; and
8) a statement relative to relocation of families to be displaced from the project
area.
NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Authority of the City
of Oshkosh that the area described in the attached "Exhibit A" is blighted and in need of

proposed Mill on Main mixed-use redevelopment project are catalyst projects in the Sawdust
District and are leading the redevelopment in the District already. The redevelopment of the
entire Sawdust District Redevelopment Area will take years to complete due to the complexity
of the area. For reference, the City’s Redevelopment Authority (RDA) started acquiring
properties in the Marion Road Redevelopment Area in the early 2000’s and 25 years later, the
area is almost fully redeveloped.

SOUTH SHORE REDEVELOPMENT AREA
Pioneer Marina/Island Area
The owners of the Pioneer Island have indicated that they plan to operate the tiki bar again this
coming summer under a temporary use permit. The City continues to work with the owner on
potential development projects and parties interested in purchasing the property.
Miles Kimball Building (Northwest corner of S. Main/9th Avenue)
The owner has formally requested that the City amend the TIF Development Agreement to
delay the completion date of MK Lofts. The developer has requested to amend the completion
date from October 1, 2023 to June 1, 2024. The Council approved this request. The developer
indicated that the project should be completed by June 1, 2024.
Boatworks Property
Chet Wesenberg and Tim Hess indicated that they are ready to purchase the RDA property to
start their project in spring. City staff will work with the developers to complete the transaction.
The developers have started their site investigation on the City’s sanitation garage site now that
the building has been demolished.
Mill on Main Redevelopment Project
The developers are discussing their proposed start date with city staff. All approvals are in place
to start construction.
West 8th Avenue RDA Property
City staff continues to receive multiple inquires on the RDA property between W. 7th and W. 8th
Avenue and work with interested parties.

MARION & PEARL REDEVELOPMENT AREA
Mercury Marine Parking Lot on RDA/City Land
RDA approved a site plan for a parking lot on multiple parcels owned by the City and RDA per
an agreement from 2006. The RDA approved a site plan for Mercury Marine to install a parking
lot but Mercury Marine and the City are working on details of the environmental remediation
responsibilities.
Merge Update
Construction for Phase I of Mackson Corners on Parcel J along the Fox River is completed. Staff
has been in communication with the developers to discuss their next project on their parcels. At
this time, they will be requesting a TIF Development Agreement Amendment to extend their
construction timeline that was originally agreed upon. They have indicated that the new
Jackson/Oregon bridge will negatively impact their proposed mixed-use development along the
Fox River and would like additional time to plan for it. Staff is working with the City Attorney,
Planning Manager, and City Manager on this request.
Morgan Crossing – Phase 2
Alexander and Bishop has proposed a multi-family building on the vacant parcel to the east of
the existing Morgan Crossing building. The Common Council approved the creation of TID#42
to help fund the remediation for the development but the developer has not approached the city
to create a Development Agreement.
ATC Easements
The City has been approached by the American Transmission Company (ATC) regarding
easements that they are requesting on City and RDA properties. The proposed easement
placements, widths, and language in the easement document are very restrictive and will
severely limit what the City and RDA could do with their properties in the future. City staff is
meeting with ATC representatives regularly to discuss our concerns with the proposed
easements. Any easements proposed on RDA property would need to be approved by RDA.
SAWYER STREET/OSHKOSH AVENUE
Sawyer Street/Oshkosh Avenue Intersection Reconstruction
City staff have added a CIP item to start the design work for the Sawyer Street/Oshkosh Avenue
reconstruction project. The RDA continues to maintain the lots that are planned to be part of the
Sawyer Street and Oshkosh Avenue intersection reconstruction once there are enough funds in
TID #35. City staff continues to monitor grant opportunities as well to help offset these
construction costs as well.
