Grantee, the receipt of which is hereby acknowledged, the Oshkosh, WI 54903-1130
Grantor does hereby give and grant unto the Grantee, its
successors and assigns, an easement in, under and over
the land hereinafter described, including the right to enter
upon said land for the purpose of construction,
maintaining, and repairing a parking lot and associated work over, under and upon
certain tracts of land situated in the City of Oshkosh, Winnebago County, Wisconsin
and described as follows:
THAT PART OF LOT 50 IN BLOCK 43 PER LEACH'S MAP OF 1894, IN THE 7TH WARD, CITY OF OSHKOSH,
WINNEBAGO COUNTY, WISCONSIN, BOUND,E,D AND DESCRIBED AS FOLLOWS: COMMENCING AT THE S.E.
CORNER OF LOT 1 IN BLOCK 43 PER LEACH S MAP OF 1894, THENCE NORTH 58°06'55" WEST ALONG THE
SOUTHERLY LINE OF SAID LOT '102.99 FT., THENCE NORTH 00°01'12'' EAST ALONG THE WEST LINE OF
SAID LOT 33.41 FT. TO THE POINT OF BEGINNING QF THE PARCEL TO BE DESCRIBED, THENCE
CONTINUING NORTH 00 01 02 EAST ALONG THE WEST LINE OF LOT 50 AFORESAID 20.00 FT., THENCE
NORTH 89°52'42" EAST ALONG THE NORTH LINE OF SAID LOT 12.73 FT., THENCE SOUTH 00°20'50" EAST
ALONG THE WESTERLY FACE OF A MASONRY BUILDING WALL 20.00 FT. TO A POINT ON THE SOUTH LINE
OF SAID LOT, THENCE SOUTH 89°52'42'' WEST ALONG SAID LINE 12.85 FT. TO THE POINT OF BEGINNING.
SAID PARCEL CONTAINS 256 SQUARE FEET. (PART OF 511 N. MAIN STREET)
Upon exercising any of the rights herein granted, Grantee shall cause the property
to be repaired and replaced in a condition similar to its condition immediately prior thereto,
and obligates itself to pay to Grantor, it successors and assigns, all actual damages caused
by construction, maintaining and repairing a parking lot over, under and upon said property.
IT IS FURTHER MUTUALLY AGREED that no building or other substantial or
permanent structure shall be placed upon said property by the Grantor.
The Grantee releases the Grantor from all debts, claims, demands, damages,
actions and causes of action whatsoever which may result from said easement heretofore
granted by Grantor, and further agrees to hold the Grantor free and harmless from any
claim for damages which may be made by reason of damages or injury to persons or
property connected therewith.
