Box 1130 Oshkosh, WI 54903-1130 920.236.5000 http://www.ci.oshkosh.wi.us TO: Advisory Park Board FROM: Mark Lyons, Planning Services Manager DATE: February 5, 2024 RE: Fees in-lieu-of parkland dedication for Lake Butte des Morts Drive Development Community Development is currently working with Red Earth, LLC, a developer who is planning a 6 phase multi-family development along Lake Butte des Morts Drive on the city’s northwest side. Common Council previously approved Phase 1 which included 80-units, clubhouse with swimming pool and recreational area. The developer is now seeking approval for the remaining phases. As part of the approval process the developer has also proposed a six-lot preliminary plat. The remaining phases are made up of 82-unit buildings and townhomes. Future phases also include various open spaces and an internal trail system that will connect to the WIOUWASH Trail. The proposed 522 units would require the dedication of 10.78 acres of parkland or pay a fee in-lieu-of land dedication which equates to $86,130 based on the current Subdivision Ordinance. The current CORP for the city recommends a Community Park, usually 15-30 acres, in this general area of the city. The subject site and the surrounding area are part of the City’s residential growth area. There have been approximately 80 platted residential lots south of Ryf Road and a majority have been developed. Adjacent to the developed areas, there are conceptual plans for approximately 100+ additional lots. The City of Oshkosh’s Comprehensive Plan identifies the surrounding area as appropriate for low density residential or conservation residential with most of the development occurring off or near Ryf Road. Community Development staff is recommending the city accept the fees in-lieu- of parkland dedication for the proposed Red Earth, LLC development along Lake Butte des Morts Drive. In evaluating the existing residential areas, in combination with the future potential residential growth area, staff feels that dedicating parkland as part of the Red Earth, LLC development would not be the appropriate location for the recommended Community Park to this area. In this instance, utilizing fee in-lieu-of would provide a greater flexibility for the City to strategically locate and develop a Community Park that will meet the broader needs of the entire residential area today and in the future near Ryf Road and Lake Butte des Morts Drive.
