HomeMy WebLinkAboutRaw Water Intake-Cng Ord 7 CHANGE ORDER CITY OF OSHKOSH, WI CITY CONTRACT 02-01, RAW WATER INTAKE AND TRANSMISSION MAIN Order No. 7 Date: September 29, 2003 Agreement Date: May 28, 2002 NAME OF PROJECT: City Contract 02-01, Raw Water Intake and Transmission Main OWNER: City of Oshkosh CONTRACTOR: Lunda Construction Company The following changes are hereby made to the CONTRACT DOCUMENTS: Contractor is hereby authorized to provide additional turbidity barrier as proposed in the April 16, 2003 letter from Lunda Construction Co. This additional turbidity barrier shall be provided at the same cost as the turbidity barrier requested by the WDNR in its letter of February 4, 2003 and as discussed with them at a meeting on the same day. Copies of these documents are attached hereto. All other conditions and requirements of the Contract Documents shall remain unchanged. The following conditions are applicable to this Change Order: Lunda Construction Company must execute this change order for an increase of $205,200 in the Contract Price, as complete payment for this work. Payment will be made on a lump sum basis for each of the three stages proposed by Lunda. The lump sum price shall include all costs to furnish, install and maintain the turbidity barrier for the duration of the project. Payment for satisfactory completion 0leach stage ;vill be made as follows: For Stage 1: $82,080 For Stage 2:$82,080 For Stage 3:$41,040 Partial payments will be made based upon the estimated percentage of work completed in each stage, as agreed to by the Resident Project Representative. This change order must be processed before payment is made for any portion of this work. 9/29/2003 C07- 1 2. Prior to issuance of this change order, Lunda Construction Company must have a Project Implementation Plan approved by the WDNR and the City of Oshkosh. 3. In the execution of the work, Lunda Construction Company must abide by all governing permits. If Lunda's work is observed to be in violation of any permit requirements, Lunda must, upon notification by the City's representative, immediately stop work until Lunda corrects the violation. All costs to remedy such non-compliance shall be at Lunda's expense. Reason for change: The Wisconsin Department of Natural Resources (WDNR) has been regularly monitoring construction on the lake for compliance with the Section 30 Permit for this project. Based on its assessment of the effectiveness of the construction methods and means being employed by the Contractor to control turbidity, the WDNR ordered that additional deep water turbidity barrier be placed around designated construction areas in the lake. Extensive discussions were held between the City, the WDNR, the Contractor and the Engineer to limit the extent of the additional barrier to be provided.. The Contractor's cost proposal for this work was reviewed by the Engineer and the Owner and found to be reasonable. The benefits of installing turbidity bzazie,' m-ound the entire work zone are many, Ihave listed some below. 1. It would be thc DNR's preferred method to contaia suspended sot/ds. The DNR has agreed to the current minimum requirements as a means to reduce the over all quantity of turbidity harrier required for this project. Bur the DNR has stared there remains the possibility of rex/n/ring additional barrier in the hture. The DNR was tumble at this time m defhae what specific conditions would require addldonal barrier other ~han a f£qh kill, bur would monitor the work m~d respond as needed. 2. Lunda is ctm'ently working wir_h a th-ne frame of 5 to 6 weeks from the time tt~e turbidity barrier/s order to the time 'it is installed for excavation/backfill work to proceed.. ShouOd the project be delayed as a result of additional barrie~ requirement at no fault 0fLunda Construction, the associated cos~ f~,om the de.lay and additional barrier could be substantJ~I. There is a great deal of work to be done during the 2003 construction season. Any delay could jeopardize completing the ~ioe installation during the 2003 season. Should ~ipe installation work be l~oved into r~h~ 2004 constructioix season, the cost could well ~e in excess of $700,000.00_ 3. h~ containing the suspended sol/ds to a relat~vcly small area at thc work zone. The water quality a~ the west shore, the beach area. the temporary 60" water line intake, the existing 36" water intake, the existing 24" water intake, and the ia/ce in general would be much better. In an effort to mitigate ongoing projec~ conflict, elhninate a potential projdct delay over bm:tier requ/remcnts, and take advantage of the above benefi~ in enclosing the work zone. (See attached) Work will not be allowed on the lake until June 1 2003 as far as excavation or disruption of the bosom of the lake. Ioe Quist indicated they would like to begin earlier, involving the pigging and cleaning of the existing intake and also upon approval the construction of the new intake crib structure. Construction of the structure would be done at the shoreline adjacent to the installed pier and would not involve any excavating mad production of turbid water. K_risty approved those operations. Further review of the DNR requirements continued. To avoid any tmbid water from entering Iviiller's Ba~v a turbidity barrier would be required across the north access to the bay. At this point Joe Quist indicated that they would like to use barrier the entire length of the project and Kristy indicated that that ff this were done she would drop the requirement for the Miller's Bay north access barrier. Next point addressed was ihe opening that would be allowed in the barrier. DNR requirement was 50' h and February 10, 2003 Page 2 Kristy next indicated that the DNR requiremem for discharge of 80 ppm must be adhered to at all times for any water being discharged back to the lake from dredging, pumxping or other means employed that causes discharge. Much discussion followed concerning ways and means. Joe Quist i~xdicated he intended to use turbidity barrier for fl~e rest of the project- Kristy Rogers also requested that the implementation plan be submitted prior to April l~t 2003 for rexSew well before the commencement of work. Box 1130 Oshkosh, V¢I 54902 Subject: Season II Construction Dear Mr. Brand: On December 17, 2002, the City, Lunda Construction and the Department met to discuss elements of the project implementation plan for Season II of the water intake and transmission construction. The City presented the results of the Season I sampling and expressed their concerns with the placement of a turbidity barrier along the entire route of the project. The Department has reviewed the submitted sampling data: The following will be required fo[ Season II (Summer/Fall 2003). · 1. Construction shall not commence until June/5,'-2003. No "in lake" work except for installation of 'the turbidity barrier shall be completed betweeh March 15 or "ice out" which ever is em:lief and June 15 of any year. 2. Turbidity barrier shal~ be insta~ed ar~und th~ ~perati~n unti~ the ~perati~n is greater than ~ ~ feet out into the lake measured from the diversion vault. One overlapped opening no greater than 50 feet wide may be created in the southern section of barrier. The barriers shall overlap a minimum of 25 feet. Turbidity barrier shall be placed across the entire north opening of Millers Bay. An overlapped opening no greater than 30 feet wide shall be created to allow navigation. The opening and navigational channel shall be clearly marked..The barriers shall overlap a minimum of 25 feet. The City shall submit a project implementation plan for Season II. It must contain a project schedule; a detailed drawing and timeline of installation for the turbidity barriers; detailed plan for con[rolling the discharge from the spoil barge including the measures to be used, monitoring plans and maintenance plans. The p!an shall be submitted to the Department by April 1, 2003. Construction shall not commence until the Department approves the plan in writing.
