HomeMy WebLinkAbout04-38FEBRUARY 24, 2004 04-38 RESOLUTION (CARRIED 5-2 LOST LAID OVER WITHDRAWN PURPOSE: GRANT CONDITIONAL USE PERMITS; APPROVE FINAL PLANNED DEVELOPMENT: (A) 2004-2020 JACKSON STREET (B) 3700 JACKSON STREET INITIATED BY: (A) DUMKE & ASSOCIATES LLC, PETITIONER (B) OSHKOSH PANTRY 41, OWNER PLAN COMMISSION RECOMMENDATION: All approved with conditions BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional use permits are hereby granted for the following properties under Section 30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as noted for each respective property, and the Planned District Overlay and final development plans, per the attached exhibits, are hereby approved. A) 2004-2020 Jackson Street A conditional use permit for a planned commercial development for construction of a multi- tenant strip commercial building, per the attached "Exhibit A", with the following conditions: 1) 2) 3) 4) 5) 6) 7) 8) 9) 10) Building elevations for the north, south, and east elevations must be approved by the Department of Community Development. The proposed north and south elevation shall contain the same level of fenestration as the west elevation. The roof lines of these elevations shall be enhanced similar to the west elevation. Wall signs shall be placed in the areas above the proposed doorways. Wall signs shall be uniform in size, scale, color, and type. The dumpster enclosure materials shall match the materials used in the exterior of the principal structure with final approval by the Department of Community Development. A loading plan shall be submitted to, and approved by, the Department of Community Development. Parking lot lighting shall be ornamental and compliment the principal structure on the site. The Department of Community Development shall approve an exterior lighting plan. Foundation/building wall planting beds shall be a minimum of three feet in width and shall be placed on all sides of the building adjacent to parking areas. The perimeter of the parking lot shall be curbed with a minimum 6 inch curb. A 10 foot setback shall be allowed along Jackson Street with setback area to include 60% additional landscaping. Eight (8) foot setbacks are allowed for the parking lot along Viola Ave. and Linwood Ave. with the setback area to include 68% additional landscaping. Landscaping shall be distributed to visually buffer the adjacent contractor's yard from views from the west and south. The development plan shall be allowed to provide a total of 53 parking spaces. Aisle widths shall be a maximum of 24 feet in width. Parking spaces shall be a maximum of 18 feet in depth. Property tax parcels to be combined through quit claim deed or any other method to be approved by the Department of Community Development before permit issuance. A 14 ft. setback allowed along east property line. No driveway access to Jackson Street. A 10 foot setback is allowed along Viola Avenue with setback area to include 60% additional landscaping. B) 3700 Jackson Street A conditional use permit for construction of a storage area addition and self-service car wash bay to an existing gas station/convenience store, per the attached "Exhibit B", with the following conditions: 1) 2) 3) 4) 5) Trash enclosure shall be constructed of masonry type materials to be approved by the Dept. of Community Development. Trash enclosure shall be relocated to meet Ordinance setback requirements or Board of Appeals variances must be obtained. Parallel parking spaces must be made 22 ft. in length. Four seasons screening must be added to the east property line to screen new parking spaces and proposed car wash addition.
