HomeMy WebLinkAboutClerk's Report.doc REPORT OF THE CITY CLERK June 8, 2004 PETITIONS RECEIVED: None COMMUNICATIONS: Letter of gratitude to Council Member Esslinger for his efforts to get Representative Gregg Underheim and other locally elected officials who represent our community in Madison before the Council and citizens. ITEM'S TO BE FILED: Cash Report for the month of April, 2004. Minutes of the April 29, 2004 meeting of the Library Board. SPECIAL CLAIMS: Special claims submitted to the City's insurance carrier: Jeff & Lynn Houts, 908 Bay Shore Drive, in the amount of $2,500.00 for damages resulting from a backed up sewer. May 26,2004 Pamela Ubrig Clerk, City of Oshkosh 215 Church Ave. Oshkosh, WI 54901 Dear Ms. Ubrig, Please pass along to Councilman Paul Esslinger a huge debt of gratitude for continuing to ask that Rep. Gregg Underheim and our other locally elected officials who are supposed to be representing us in Madison, come before the city council and people of Oshkosh to address our concerns. It was nice to see Mr. Underheim was finally able to find time to make such an appearance at City Hall and I am sure I am not alone in saying it will be nice ifhe comes back in the future to address other issues affecting Oshkosh. Hopefully, however, when he comes back in the future it will not be during an election season where it looks like he is politicking. In any event, many thanks again to Paul for continuing to watch out for all of our best interests and for attempting to hold other elected officials as accountable for their actions as he always is. He understands the true meaning of being a "public servant," and should be a shining example for others to follow. Thanks a bunch! - Cheryl 5/26/2004 >;: Dear Oshkosh Common Council Members: I urge you to reject the claim for damages submitted by several local restaurant and tavern owners and to defend the current ordinance against their legal challenges, for the following reasons: First and foremost, this ordinance protects the health and safety of Oshkosh residents, both restaurant patrons and restaurant employees. Citizens have a right to breath clean air and communities have the right to take appropriate steps to ensure protection. The ordinance is in place because a majority of Oshkosh voters voted to approve it at the April 6 spring election. Asking you, our elected officials, to overturn a valid election is asking you to blatantly ignore the will of the people and the democratic process. Asking taxpayers to provide monetary damages without providing any evidence of lost income is totally unreasonable. This is particularly unfair to taxpayers in light of the fact the ordinance provides a hardship exemption that allows restaurants (after July 19) to become exempt if they demonstrate an economic hardship. Even more absurd, several of the businesses asking for damages are not subject to the ordinance and one actually stated in the Northwestern that his profits have increased since enactment of the ordinance. Questioning the direct legislation process, at this point in time, is ridiculous. The City Clerk certified the ballot initiative signatures, after which time the Council voted unanimously to place the ordinance on the ballot 60 days prior to the election. This provided ample time to raise questions about the election process or the proposed language, before the voters spoke. It is unfortunate that a small group of restaurant and tavern owners continue to oppose an ordinance that is protecting the health of their own workers and customers. It is especially disappointing that these same owners are attempting to overturn an election with after-the-fact complaints about the process and frivolous complaints about how the ballot was laid out. I encourage the City of Oshkosh to dismiss the damage complaints as baseless and defend the ordinance against the same legal challenges that have been dismissed by numerous courts across the country.
