KOELLER STREET INITIATED BY: OSHKOSH THEATRES CORP., OWNER PLAN COMMISSION RECOMMENDATION: Approved w/conditions BE IT RESOLVED by the Common Council of the City of Oshkosh that a conditional use permit for expansion of an existing planned commercial development to permit construction of an addition, to include, but not limited to, three new screen auditoriums, per the attached, is hereby approved with the following conditions: 1 3) 4) 5) 6) All new and existing mechanical appurtenances be screened in accordance with Section 30-35(I)(5) of the Zoning Ordinance. The owner/petitioner provide a cross-access parking agreement indicating the compliant amount of parking spaces will be provided to account for any loss of parking on the subject property. The front yard setback shall be no closer than the existing structure's setback. The two tax parcels encompassing the Theatre development be combined into one tax parcel. All landscaping displaced as part of the expansion project be replaced and included in a revised landscaping plan. Increased level of foundation plantings be provided along the west elevation. Storm easement along S. Koeller Street be modified to allow pedestrian access. BE IT FURTHER RESOLVED that the Common Council of the City of Oshkosh hereby approves of the Planned District Overlay and final development plan per the attached.
