PURPOSE:
APPROVE LABOR CONTRACT/LOCAL 796C, AFSCME, AFL-CIO
OSHKOSH PROFESSIONAL EMPLOYEES UNION
INITIATED BY: CITY ADMINISTRATION
WHEREAS, the City of Oshkosh and Oshkosh City Employee Union, Local 796C,
AFSCME, AFL-CIO, Oshkosh Professional Employees Union previously negotiated a
Working Conditions Agreement for calendar years 2001-2003; and
WHEREAS, the parties reached a tentative agreement for certain changes to the
labor contract for years 2004-2006 as reflected in the attachment; and
WHEREAS, Local 796C has ratified these changes and it is appropriate for the
Common Council to also ratify this agreement;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the attached changes to the current labor contract with Local 796C,
AFSCME, AFL-CIO, Oshkosh Professional Employees Union, are approved, and the
proper City officials are authorized and directed to enter into an appropriate agreement for
these purposes, the execution copy being deemed approved by their respective
signatures, and said City officials are further authorized and directed to take those steps
necessary to implement the terms and conditions of the labor contract.

TENTATIVE AGREEMENT

All provisions of the previous contract shall continue in the successor contract except for
the following:
1. Article II - Section 1, Compensation: Add the following: "June 1, 2004, all
employees shall participate in the direct deposit payroll system."
2. Article VII - Health Insurance: Revise contract to reflect dual choice PPO
with an EPO, effective June 1,2004.

Change employee contribution levels to reflect the following:
A. PPO
Effective June 1,2004, employees will contribute 4% up to a
maximum of $20 per month toward single; $35 per month towards
dual and $50 per month towards the family premium equivalent.
Effective January 1, 2005, 5% not to exceed $25/$40/$55.
Effective January 1, 2006, 5% not to exceed $30/$45/$60.
B. EPO
Effective June 1,2004, employees will contribute 3% up to a
maximum of $15 per month toward single; $25 per month towards
dual and $30 per month towards the family premium equivalent.
Effective January 1, 2005 -4% not to exceed $20/$35/$50.
Effective January 1, 2006 - 4% not to exceed $20/$40/$50.
3. Article XXIX - Duration: Change the dates to provide for a three-year
agreement on all items.
4. Housekeepin.q: The City proposed to "clean up" extraneous language in
the contract such as deleting effective dates or provisions that are no longer needed,
correct typographical errors, and revise language to refer to both men and women, etc.
The parties agreed on these changes.
5. Wages: 2.25/2.5/2.75 percent increase is 2004, 2005 and 2006,
respectively.
6. Article XV - Emer.qency Leave, Section 1: Add: "step brother, step sister,
son-in-law, daughter-in-law, guardian, half sister, half brother."
7. Article XII - Lonqevity:
Retain current Section 1 and add: After June 1, 2004, no employee shall receive
longevity pay under this Section.
Section 2. Employees who have attained 10-14 years of employment shall
receive $500 payable the first pay period of the calendar year. Employees who have
attained 15-19 years of employment shall receive $750 payable the first pay period of
the first period of the calendar year. Employees who have attained 20 and over years
of employment shall receive $1,000 payable the first pay period of the calendar year.

Those employees reaching their 10 , 15 and 20th year of service shall earn their

longevity for that year on a prorated basis. [NOTE: These longevity payments will be
prorated in 2004 from June 1, 2004.]
8. Article XlV - Vacation:
Add: E. 25 years of continuous service = 5 weeks plus one day vacation
effective 1/1/06).
9. Article II - Pay Policy:
Add: Section 4. Employees assigned to do work in a higher rated classification
for a period in excess of five (5) days shall be paid for all such time in the higher
classification at the rate that is closest to, but not less than, his or her current wage rate.
10. Article VIII - Holidays: Delete second paragraph and insert the following:
Employees required to work after being scheduled to do so by his/her immediate
supervisor on the above specified holidays shall receive 2.0 times their normal hourly
rate for all time worked in addition to holiday pay.
11. Article XXVII - Seniority Layoff and Job Postinqs: Section 3, add the
following: The City will provide a two-week notice of layoff to affected employees.

14. Civil Enqineer: Civil Engineer I becomes Civil Engineer and remains at
pay grade 9. New Civil Engineer I assigned to pay grade 10, effective 6-1-04. New
duties to be assigned. Two existing Civil Engineer I's to be moved into new position at
step closest to current salary that provides an increase.
15. Compensatory Time: Article Xl, Section 1: delete last sentence and insert
the following: "Employee shall have the option to receive a payout of compensatory time
on a semi-annual basis."
