Hi, my name is Rafael Escamilla the owner/agent of Durango's
Mexican Restaurant. I have been in Oshkosh, WI for three
years and have really enjoyed doing business here. In the
meantime, I have had a lot of customers that have been
brought through the area for the EAA or Packer games and
many customers have asked for margaritas and mixed drinks.
When the waiters tell the customers that we do not serve
alcohol, only beer and wine some customers have left to go to
another establishment. As you know, the restaurant business
is a hard business to survive in, I appreciate that you contacted
me to apply for the liquor license. If you have any questions

Liquor License-Letter of Intent
Our organization's desire to obtain a liquor license in the city of
Oshkosh centers on finding a home base for Fever Pitch Magazine and
Music. Fever Pitch is a nationally recognized independent magazine and
record label that has its roots imbedded deeply in the Fox Valley. Our main
goal is to use our talents and connections to bring original arts and
entertainment to an area that is starving for something exciting and new.
Currently Fever Pitch is a Limited Liability Company operating as a
magazine and record label. Because of the addition of some new members
and our new plan to open a club, Fever Pitch will soon be reorganized as two
separate LLCs working towards the same goal.
Fever Pitch LLC will remain a magazine and record label, but will
also become an entertainment promotions company as well. Fever Pitch
LLC will be responsible for bringing in acts to the club. The new sister
organization, FPE (Fever Pitch Entertainment) will be the actual bar/club
itself. Lucinda Vette d/b/a FPE is applying for the liquor license as an
individual, however the businesses will be working symbiotically toward the
development of the FeverPitch venue.
The Background of Fever Pitch LLC
Fever Pitch's staffis a collection of writers, artists, musicians,
music/film retailers, and many others, spread across America. Every
member at one time or another lived, worked, and in some cases were
educated in Oshkosh and the Fox Valley area. We are currently in
production of our 9th issue of the magazine, and there are seven Cds slated
for release this summer alone. We have made quite a name for ourselves on
both the local, national, and international levels, and soon hope to be
recognized as one of the leading voices in the world of independent art,
music, and film.

"How and Why?"- Fever Pitch in Oshkosh
Although many of FP's staff no longer lives in the area, all of us have
been trying to find a way to give something back to the community where
we met, befriended one another, and initially formed the company. After
much thought and research,, the unanimous decision has been a promotions
company and concert venue of some type. With our talents and connections
we could put a new, legitimate, nationally recognized, artistic face on
Oshkosh and the surrounding areas. We are in constant contact with the
local, statewide, Midwest, and national music scenes. Our goal is to bring
something here that does not exist north of Milwaukee, Madison, or even
Chicago for that matter.
Part 1-Fever Pitch "the club"
We have finally found a building that will be almost perfect for our
needs, not only in terms of size and space, but also location. The Time
Theatre on the 400 block of Main Street is a beautiful, historic venue that
has long been in need ofa faceiift. To be a success, it also needs to be mn by
a creative team of artists, business folk, and thinkers who have the
connections to bring truly interesting acts and entertainment to Oshkosh, as
well as understanding the community enough to attract local support and
interest. We feel that Fever Pitch fits the bill perfectly, and we will do
anything to make it a successful endeavor.
Our plans are to renovate the building and with the help of its owners,
and bring it up to code. The idea is to mm the ground floor into a concert
venue/bar, where we will showcase some of the best live music, theatre, and
comedy the world has to offer, from jazz to classical as well as from rock to
techno. The stage will also be set up to do live recordings at any time, much
like Mongo's in Appleton. This will be a benefit to local music and
musicians, national acts that record there for Fever Pitch Music will bring
mom attention to the city, and it will allow us to produce commercials, film
and audio, in-house. When there is not an act performing downstairs we will
be playing selections from our massive company vinyl record collection, as
well as new, yet sometimes unheard of, promotional music that is sent to us
from hundreds of record labels on a daily basis.
The upstairs will remain a movie theatre that will show films daily
from many different genres. Our focus will mainly be on independent,
documentary, foreign, and classic films. The films will all be free to the
public, and you will be able to consume alcoholic beverages while you
watch! This idea has worked VERY well in bigger cities; there should be no
reason it cannot work here, if done right. There is even the possibility of
bringing independent and documentary filmmakers in to screen and discuss
their films with a live audience! The key is to give the people what they
want already, and at the same time to turn them on to new things they may
not be aware of.
Part 2- Fever Pitch Promotions
We at Fever Pitch understand the mindset and values of this
community very, very well. So it is obvious to us that a venue under our
direction in this area must cater to many different types of styles, age groups,
and tastes. We understand that many people will only come out to see artists
that they immediately recognize, right away.
Therefore, it is our intention to start an entertainment promotions
company to help book and bring bigger and better acts to Oshkosh at many
different locations. Through our magazine and record label contacts we can
get touch with almost any act you can imagine. Our goal here is to reach all
ages from 12 and up.
We have already started talking to people about working with venues
like the Grand Opera House, Studio Hall, and the soon to be competed
Waterfest grounds.
Benefits and Risks
We are very aware that most bars/taverns are bound for failure within
a very short period of time. That is why when making your decision we ask
that you think of us as a beneficial, much-needed, very hip entertainment
option for the area first, and as a bar second. Downtown Oshkosh is starving
for culture and entertainment. When hunting for a success story, you need
look no farther than the amazing improvements that have been made to
Appleton's College Avenue, which now supports a very attractive, diverse,
financially thriving, multi-genre, happening scene. It gives you the old
fashioned downtown flavor, with a very modem look and attitude. We see
similar things happening in Oshkosh in the near future, if we all pull
together and rally to the cause. Fever Pitch could very well be the catalyst
needed to push Oshkosh into a downtown cultural Renaissance. Again, we
could take this idea ANYWHERE, but we want to give something back to
our community. Please keep in mind; College Ave has NOTHING like
Fever Pitch is proposing.
Why Not Just Be a Concert Venue? Why is a Liquor License Needed?
As I stated before, we know this area very well. In order to get people
to come to a venue like we are proposing, the ability to serve alcohol is a
must have. In order to get people to try new things, you must give them what
they are used to having first. We think that people will flock to refreshing,
live entertainment if they can still be allowed to drink at competitive
Oshkosh prices. We have spoken to make bar owners on Main Street and
their opinion is that having Fever Pitch downtown would HELP and not hurt
their businesses.
Some More ThinKs We Already Have in the Works
· Fever Pitch as a whole is comprised of entrepreneurs, journalists,
music and film educators, retail and entertainment business people,
innovative actors/musicians/filmmakers, recording engineers,
producers, philosophers, and even a lawyer! We understand what we
are getting into and have the knowledge and the drive to make the
venture a success.
We are working on an idea for a small unique shuttle that would nm
free of charge from the UWO campus to Main Street. Other
downtown bar owners agree that it would help to encourage the
THOUSANDS of students only four blocks away to come to the 400-
600 blocks~
· We have vast ties with both UWO and Lawrence University music
and art schools. It is our intention to expand our connections to
colleges in the area including, Ripon College, UW Fox Valley,
Marion College, UW Green Bay, and UW Stevens Point. All of these
schools are within an hour or so from Oshkosh and in our opinion, if
marketed correctly, we could see an influx of visiting students.
Especially when we are throwing larger shows.
· The UWO Recording and Music Business departments are hungry to
use the new skills they are learning. However, they have no place
besides the university in which to get some "real world" experience.
We would like to offer our venue and services to them.
· To further promote our venue and shows, as well as other events in
the community we would like to set up a smaller, 8-12 page,
newsprint version of Fever Pitch exclusively for distribution in the
Fox Valley. In it we would feature interviews and articles about artists
we are bringing to town and working with. To get people to pick it up,
we would like to do something comedic/fake news along the lines of
The Onion or Vice Magazine. It could easily be paid for with some
basic local advertising to promote Oshkosh's new "scene" by the
businesses involved. We would then distribute them by hand and in
bundles monthly to "hotspots" within an hour radius of Oshkosh.
Namely, college campuses, music stores, coffee houses, art shops, etc.
· Acts we would bring in would have something for everybody. Rock,
jazz, classical, country, hip-hop, techno and everything else under the
sun! These are acts that probably have NEVER been to the area
before.
· We also intend to bring in comedians, theatre groups, spoken word
people, guest speakers, and much more.
· The films we would show would be very different from anything in
Wisconsin. There would most likely be themed show times like:
documentary Wednesday, or classic film Friday.
· We would also like to reach out to many different age groups as well.
There would be things like classic and strange cartoons on S. aturday
morning for the kids, and classic movies after church on Sundays for
the older folks, etc.

Request for a Liquor License
Submitted by Timothy Merten-owner of 430 N. Main St.
The purpose of this application is to provide a liquor license for the
Hero's Restaurant site located at 430 N. Main St. The Hero's location was
formerly the President Bar from 1930 to the early 60's. In the late 70's, 430
N. Main St. was remodeled and named Hero's Sub & Paste Shop. For the
last 25 years Hero's has Operated as a sandwich shop (with a beer license)
but like many downtown businesses Hero's has had its financial troubles.
An additional revenue source from liquor sale would certainly help Hero's
financial stability.
The Hero's property is currently listed with a commercial property
realtor. The listing includes both the real estate (which includes a recently
remodeled dining and bar area) and all restaurant and bar equipment
(coolers, refrigerators, grills, tables, chairs, etc.). This packaging allows
Hero's to be offered as a modem turnkey business.
There is considerable interest to reopen Hero's as a restaurant/bar
including one offer to purchase. All interests in the property including the
offer to purchase are contingent upon securing a liquor license. A liquor
license would energize the transformation of the Hero's site from a vacant
downtown building with a great deal of potential to an up and going stable
downtown business. My intent if awarded a liquor license is to immediately
sell and work with the new owner to re-open as soon as possible.
In Conclusion, the missing link between a motivated seller and a
motivated buyer is a liquor license which could literally allow the Hero's
site to be opened overnight building on the success of Oshkosh's downtown
redevelopment plan.

Dear City Council,
We are writing this letter to gain your support for the corresponding liquor licehse
which we are applying for. We hope to accomplish this by presenting you with our
vision.
Our vision starts with 4~N. Main St. The last time it was occupied was by
'Heros', almost one year ago. It is our intent to purchase the vacant property and
transform it into a dashing and fashionable establishment featuring fine food and higher
end drinks. Our drinks will include a large variety of top shelf liquor, a large venue of
wine, Old Fashions, and a unique selection of Martini recipes available to our customers.
We will have live music of various types including Contemporary and Classical Jazz,
Folk, and Blues. These talents will be supplied with some help from Kurt Stein of Fever
Pitch Magazine.
We feel that locating 'IikoPatrick's' on Main St. will assist in the redevelopment
and prosperity of the downtown area. We want to attract more customers to the
downtown where we can share them with similar establishments such as 'Peabody's',
'Oblio's', and 'The Chalice'. Some of our food products will be purchased from Main St.
suppliers, such as 'Schoenberger's' in an effort to support local business. During the
daytime, members of the community will have the convenience of being able to eat lunch
While doing some shopping downtown.
Renovation of the building will include a face lift for the front of the building,
reflecting the name ~IikoPatrick~s'. Inside, we will expose more of the natural brick
walls~ The kitchen will be pushed bacl/in the building, taking it out of Patron's view,
eliminating an eye soar} and wiil open up mom space, we will be working out of an
updated kitchen, making our menu more diverse than the preexisting 'Heros'.' The
reslrooms will also be relocated fowards the rear of the build'mg to open up more space.
There are several features we want to add in order to bring a unique aunosphere
and posh clientele to the downtown. We envision having slate or marble behind the bar
with water running over it. It will be accented by lights of various color enveloping the
water spilling over the slate or marble. We also want to create a backlit glass ceiling
resembling the night sky, airbrushed in midnight and azure blues. Them will appear to be
a twinkling of distant constellations. Rather than the common beer signs, we will have
fine art and historical photographs of downtown Oshkosh on display. It is our intent to
show the beauty of downtown Oshkosh "On The Water" with the fusion of modem and
antique elements.
We have received support from many local tavern and restaurant owners in our
quest to operate a successful bus'mess, many of which have akeady helped in our initial
planning. Receiving a liquor license is an essential component of many successful
restaurants, bars, markets, and other food or beverage retail businesses. It will be
essential to our daytime business to maintain a steady nightthne income. When we
combIne a daytime and nighttime income we will be able to accomplish our goals.

I would like to obtain the combination class B license at La Hacienda located at
2107 N Jackson St. My business has been open as of April 30, 2004. I feel that my
business would greatly benefit from the license due to the fact that there aren't
many north side establishments. Therefore I would like to be able to serve
margaritas to my customers. If the council would choose me I would make use of
this combination class B license right away.

To Whom It May Concern:
I am applying for a Combination Class B Liquor License for 428
North Main Street. If awarded the license, my intent is to further
pursue the possibility of opening a "Cafe" style restaurant that
offers simple food dishes during restaurant hours and is open
later in the evening with a "Lounge" style bar atmosphere.
Having a liquor license for this establishment is essential in order
to generate enough revenue to operate the business. The
license would allow us to stay open later in the evening and
generate income as well as being open during daytime hours.
428 North Main Street is in the heart of Downtown Oshkosh. In
order to enhance and improve the quality of the Downtown,
establishments like this are essential to bring people into the
area on a daily basis as their destination. I believe that this type
of establishment would compliment the existing bars and
restaurants in the Downtown.
