PURPOSE:
APPROVE LABOR CONTRACT / OSHKOSH FIREFIGHTERS
INITIATED BY: CITY ADMINISTRATION
WHEREAS, the City of Oshkosh and Local No. 316 I.A.F.F. previously negotiated
a Working Conditions Agreement for calendar years 2001, 2002, and 2003; and
WHEREAS, the parties reached a tentative agreement for certain changes to the
labor contract for years 2004-2006 as reflected in the attachment; and
WHEREAS, Local No. 316 I.A.F.F. has ratified these changes and it is appropriate
for the Common Council to also ratify this agreement;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the attached changes to the current labor contract with Local No. 316
I.A.F.F. are approved, and the proper City officials are authorized and directed to enter
into an appropriate agreement for these purposes, the execution copy being deemed
approved by their respective signatures, and said City officials are further authorized and
directed to take those steps necessary to implement the terms and conditions of the labor
contract.

All provisions of the previous contract shall continue in the successor Agreement except for any
tentative agreements reached and the following:
1. Article V - Pay Policy: Add the following: "Effective as soon as
administratively feasible after the contract is settled, all employees shall participate in the direct
deposit payroll system."
2. Article X - Health Insurance: Revise contract to reflect dual choice PPO with an
EPO, effective 05-01-2004

Change employee contribution levels to reflect the following:
A. PPO
Effective 05-01-2004, employees will contribute 4% up to a maximum of
$20 per month toward single; $35 per month towards dual and $50 per
month towards the family premium equivalent.
Effective January 1, 2005, 5% not to exceed $25/$40/$55.
Effective January 1, 2006, 5% not to exceed $30/$45/$60.
B. EPO
Effective 05-01-2004, employees will contribute 3% up to a maximum of
$15 per month toward single; $25 per month towards dual and $30 per
month towards the family premium equivalent.
Effective January 1, 2005 - 4% not to exceed $20/$35/$50.
Effective January 1, 2006 - 4% not to exceed $20/$40/$50
3. Duration: Three year agreement, January 1, 2004 through December 31, 2006.
4. Article XIII - Funeral Leave (p. 15): (Effective after contract settled.)
(1) Change "wife" to "spouse."
(2) Add "son-in-law, daughter-in-law, half-brother, half-sister."
5. Wages: 2.25/2.5/2.75 percent increase in 2004, 2005 and 2006, respectively.
6. Tentative Agreements: Incorporate the 12/1/03 tentative agreements into the
Agreement.
7. Exhibit A - Longevity: Revise as follows: Effective at the same time the health
insurance changes in number 2 above become effective, i.e. 05-01-2004.

* No employee shall receive longevity pay at five years unless he/she is receiving
it as of the date the Agreement is ratified by the City.
8. Exhibit A - Wages, Section III: Revise first sentence in first paragraph to read:
Employees who are required to maintain a Paramedic license shall receive a 4.0% premium in
addition to their normal rate. (Effective 01-01-2004.)

Add: Employees who are required to maintain any level of an Emergency Medical
Technician license, under the level of Paramedic, shall receive a 1. ! % premium in addition to
their normal rate of pay. (Effective 01-01-2004.)
Delete last sentence of first paragraph under Section III. (Effective 01-01-2004.)
9. Article XIX - Promotional Procedure: Delete existing provisions and insert:
Promotion to the ranks of Equipment Operator and Fire Lieutenant shall be made by the
Fire Chief, subject to the approval of the Police and Fire Commission, in order of the
most senior qualified candidate from the promotion list. Every candidate receiving a
promotion shall be subject to completion of a successful one-year probationary period in
the promoted rank. During probation, an employee will be formally evaluated every
three months or more frequently if necessary. An employee shall be notified of a
deficiency(les) and a specific procedure(s) to correct the deficiency(ies). An employee
may be returned to his/her former position at his/her former rate of pay in the event the
employee does not correct the deficiencies identified.
Qualifications for staff positions, including the promotional criteria and composite score
necessary for promotion, shall be established by the Fire Chief. Promotions to all other
positions shall be made by the Fire Chief.
10. Article XIII - Holiday Leave: revise second paragraph to read as follows:
Effective December 1, 2002, all other employees with the exception of Lt. Inspector and
Lt. Instructor, shall receive one combination holiday as time off. Effective 01-01-2006,
after 25 years of service, all other employees with the exception of Lt. Inspector and Lt.
Instructor, shall receive an additional eight (8) hours combination holiday as time off.
This combination holiday time shall follow the same rules for scheduling as paid
holidays. If this eight-hour combination holiday cannot be scheduled due to staffing
constraints, it shall be paid out in straight time as outlined in Article XIII (Holiday Pay).
11. Article XIII - Vacations (page 12)
In Section A, delete paragraph number 2, in its entirety and insert the following:
Effective 01-01-2005:
Unless the City determines that its staffing needs allow for larger numbers of employees
to be on vacation time, no more than a total of four (4) employees per shift shall be on
vacation. During the months of January and February, employees assigned to the
Training Division, Inspections Division or attending the National Fire Academy shall
count only as the fourth vacation slot.
In Section A, insert in paragraph number 4, new second sentence to read as follows:
Prime time shall be defined as June, July, August, the last two weeks of November and
the last two weeks of December.
TENTATIVE AGREEMENTS
between the
CITY OF OSIIKOSH
and
LOCAL 316, INTERNATIONAL ASSOCIATION OF FIREFIGHTERS

The City of Oshkosh (hereinafter referred to as the "City") and Local 316, International
Association of Firefighters (hereinafter referred to as the "Union") hereby agree as follows:
1. Article XIII - Vacation - 56 Hour Employees: Create a new no. 8 as follows:
"Employees must give no less than twenty-four (24) hours advance notice when
cancelin~ previously scheduled time offfor personal holiday and eompansatory time if the City
incurs overtime in scheduling a replacement employee. In the event the City does not incur
overtime in scheduling a replacement employee, then a cancellation notice of less than twenty-
four (24) hours shall be at the discretion of the Duty Chief."
Create a new no. 9 to read:
"Employees must give no less than twenty-four (24) hours advance notice when
canceling previously scheduled vacation." Cancellation of the previously scheduled vacation
day must be mediately accompanied by a move to an alternate date.
Article VI - Call-In Time and Off-Dut,? Time: Insert after the first sentence in the
first paragraph:
"The City must give no less than twelve (12) hours advance notice to an employee when
canceling his/her previously scheduled overtime. In the event the City's notice is less than
twelve (12) hours, the employee shall be granted the three (3) hour minimum pay at time and
one-half.
3. Article XIII - Sick Leave, p. 14, ~aragraph I: Delete second sentence:
"However, no leave shall be granted under the subsection if the spouse of the employee is
employed and continues to work during the absence &the employee."
4. Housekeeping: The City proposes to "clean up" extraneous language in the
contract such as deleting effective dates or provisions that are no longer needed, correct
typographical errors, and revise language to refer to both men and women, etc. The Union
agreed with the changes except wanted to retain the note at the end of Article X on page 11
under Income Continuation Insurance. The City agreed.
