PURPOSE:
INITIATED BY:
GRANT PRIVILEGE IN STREET / MARION ROAD, ADJACENT
TO MERCURY MARINE
SIGMA ENVIRONMENTAL SERVICES & MERCURY MARINE,
PETITIONERS
WHEREAS, Sigma Environmental Services and Mercury Marine have requested
the Common Council grant them the privilege of installing a groundwater monitoring well
within the right-of-way of Marion Road, adjacent to Mercury Marine's Plant 64, per the
attached; and
WHEREAS, Section 66.0425, Wis. Stats., provides for the granting of a privilege
in a right-of-way; and
WHEREAS, the Plan Commission has approved of this request with conditions.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to grant Sigma
Environmental Services and Mercury Marine the privilege of installing a groundwater
monitoring well within the right-of-way of Marion Road, per the attached, contingent
upon the following:

The well(s) be installed in a manner that is approved by the Department of Public
Works with no modifications or changes in construction procedure without prior
approval by the Department of Public Works.
If no longer needed, the well(s) be properly abandoned and removed in
accordance with City standards and under the direction of the Department of
Public Works.
Any problem which may arise as a result of the placement of the well(s) be the
responsibility of the petitioners to correct in coordination with the Department of
Public Works.
All appropriate permits be obtained prior to the start of placement of the well(s).
The well(s) be modified or removed immediately upon the request of the City.
The petitioners secure and submit to the City Clerk a separate insurance policy
which names the City as an additional insured with a minimum coverage of
$200,000 per person and $500,000 in general aggregate.
It is the responsibility of the petitioners to file in a timely manner a new insurance
certificate with the City Clerk upon expiration of an existing certificate. Failure to
do so will result in the revocation of the privilege in street upon 10 days notice.
The petitioners execute a hold harmless agreement with the City.
Analytical test data derived from the monitoring well(s) be made available to the
City's environmental consultant.
Access to the monitoring well(s) to measure groundwater levels be made
available to the City's environmental consultant.

Dear Mr. Burich,
Sigma Environmental Services, Inc. (Sigma), on behalf of Mercury Madne, is in
the process of continuing the subsurface soil and groundwater investigation
associated with the MercurY Marine Plant 64 site located at 455 Marion Road,
Oshkosh, Wisconsin.
Based on the environmental data generated to dale, one off-site monitoring well
is proposed to further delineate the extent of chlorinated impacts to the soil and
groundwater associated with the former Mercury Madne release. Delineation of
the extent of soil and groundwater impacts, specifically in the northeast direction,
was required by the Wisconsin Department of Natural Resources 0NDNR) on
December 3, 2002 and under Wisconsin Administrative Code, Chapter NR 716.
In order to meet the requirements of the WDNR, Sigma is requesting the City of
Oshkosh grant Sigma permission install one groundwater monitoring well in the
Marion Street Right-of-Way. The proposed monitoring well location is attached.
Please note that the drilling location which we discussed with Susan Kepplinger
on March 9, 2004 has been moved to the east, therefore allowing us to drill in the
targer grass area. An underground electric line is present in the grass area
therefore moving the location to the larger grass area will allow a greater
distance between the proposed monitoring well and underground electric line.
One year of quarterly groundwater monitoring is proposed for the proposed
monitoring'well location. Therefore, at a minimum, the monitoring well wilt remain
in the Marion Road Right-of-way for one year. Based on chlorinated
concentrations at the proposed monitoring well location, Sigma will determine
after the last quarterly groundwater monitoring event if the monitoring well can be
abandoned.
As discussed on March 11, 2004, Sigma will provide the City of Oshkosh
environmental consultants (STS Consultants) with historical groundwater
analytical data and also groundwater elevations for the Mercury Marine Plant 64
property. STS will be able to access the proposed monitoring well in the Marion
Road Right-of-way to record groundwater elevation data. However, if additional
:groundwater elevation data is needed for the monitoring wells located on the
Mercury Marine Plant 64 property, STS Consultants will need to coordinate with
Sigma to obtain that information.
Currently, additional ddlling activities at the s'[te have been scheduled for March
18, 2004 and, if possible, we would like to include the installation of the proposed
monitoring well with the March 18, 2004 investigation activities. Sigma
