PROCEEDINGS OF THE COMMON COUNCIL
ClTY OF OSHKOSH, WISCONSIN
SPECIAL MEETING held Monday, February 23, 2004 at 5:30 p.m. in the Council
Chambers at City Hall.
Mayor Hintz presided.
PRESENT: Council Members Shirley Mattox, William Castle, Frank Tower, Brian
Poeschl, Paul Esslinger, Mark Harris, and Stephen Hintz.
ALSO PRESENT: Warren Kraft, Acting City Manager/City Attorney, City Clerk, Pam
Ubrig.
Resolution 04-37 Set Referendum to Adopt Ordinance
MOTION: ADOPT (Esslinger; second, Tower)
MOTION: AMEND TO ADD "AND THAT THE CITY CANNOT ESTABLISH
A SMOKING POLICY FOR PRIVATELY HELD BUSINESSES"
(Hintz; second, Castle)
CARRIED: Ayes (7) Mattox, Castle, Tower, Poeschl, Esslinger, Harris, Hintz

Council Member Castle stated it was good to have both questions on the ballot at the
same time. He questioned what the exact wording would be on the ballot and which
question would be listed first.
Council Member Harris explained he was in favor of the ban on smoking. He hoped
citizens would educate themselves on the referendum questions. He also questioned
the outcome if both questions would pass.
Council Member Esslinger stated both groups did meet the requirements for direct
legislation and questioned if everything was done legally.
Mr. Kraft responded.
Mayor Hintz expressed his concerns regarding the legality of the issue if the referendum
passes.

Resolution 04-37 Set Referendum to Adopt Ordinance
Margy Davey, 885 Portside Court, stated she was opposed to the Citizens for Freedom
of Choice question on the April ballot. She felt a second question on the ballot would
confuse the voters.
David Todd, 2123 Fairview Street, representing Razz MaTazz Grill & Spirits, urged
Council to support placing the question on the April ballot.
MOTION: ADJOURN (Esslinger; second, Poeschl)
CARRIED: VOICE VOTE
The meeting adjourned at 5:55 p.m.
