Minutes of the December 18, 2003 meeting of the Library Board,
· Certification regarding the Direct Legislation Petition filed January 21, 2004, the
petition meets applicable statutory requirement.
SPECIAL CLAIMS:
Special claims submitted to the City's insurance carrier:
Kim Servin, 824 Powers Street, in the amount of $1,957.78 for damages to her vehicle as
a result of the snow plow hitting it.

14-1.2 OF THE OSt~OSH lvfUNICIPLE CODE PERTAINING TO SMOKING
INSIDE OSI-~OSH BUSINESSES.
WI-IEREAS:
A. It is recognized that the use of tobacco products is lawful under federal
and sta~e law for any person who has reached their eighteenth birthday.
B. It is also recograzed tlm private businesses must conduct their business
ander the law, both store and federal, that pertain to said business.
C. It is also recognized that the citizens of Oshkosh have the right to choose
the type of businesses they wish to patronize.
NOW, THEREFORE THE CITY COUNCIL DO ORDAINS AS FOLLOWS:
SECTION 1. That Section 14-1.2 of the Oshkosh Municipal Code pertaining
to smoking inside Oshkosh businesses is created to read as follows:

A. Any privately held Oshkosh business will
decide a smoking pol/cy for said business until §uch time, there is a
mandated smoking policy either at the State of Wisconsin or at the Federal
level.

be superceded by this ordinance.

I, Pamela R. Ubrig, City Clerk for the City of Oshkosh, Winnebago County,
Wisconsin, do hereby certify that I have examined the attached petition and
to the best of my ability and knowledge have determined the following:
A minimum of 2,822 signatures are required to meet 15% of the 2002
Governor's Election. A total of 3,605 signatures were filed; 306
signatures were disqualified; 276 signatures were in need of correction;
leaving a sufficient total number of 3,023 signatures.
2. The petition ordinance request is in proper form.
