Director of Public Works City of Oshkosh PO Box 1130 Oshkosh WI 54903-1130 VIA FAX 920-236-5068 R_E: Edison Estates Mobile Home Park Dear Dave: This letter is to confirm our recent telephone conversations and e-mails regarding the proposed dedication of right of way and installation of sewer and water for the above referenced property. We understand that the hearing regarding the initial resolution for the sanitary sewer and water main will be held this evening in front of the City of Oshkosh Common Council. Unfortunately, I am unable to attend that meeting and, therefore request that this correspondence be included as part of the official record. WH Development Group, LLC (which is the ownership entity of Edison Estates) supports the installation of municipal sewer as proposed. We understand that we will be assessed $12,848.85 for our portion of the sewer installation, Along with the sewer installation will be the installation of municipal water. Since our property will be served by municipal water that will be accessed from Fountain Avenue, we request that we are not assessed the $17;374.50 for water installation. We are makl,ng this request because our property will not be utilizing the water. The two adjacent properties will receive the benefit of the water installation. Therefore, we feel those property owners should pay for our portion of the water assessment. In the alternative, we suggest that the city consider deferring our special assessment for the water installation. We plan to hook up to the municipal water system in Fountain Avenue and understand we will be responsible for the deferred Fountain Avenue water special assessment in the amount of $3,369 and sewer assessment in the amount of $3,116. Because this is proposed as a dedication for a public right of way, the city has requested the termination of existing utility easements and re-location of electric poles and lines. Ail three properties are serviced by the electric that originates on FOuntain Avenue and runs on our property through an easement tO the north. Since all three properties are EO. January 13, 2004 Page 2 serviced, we request that the re-location cos/s (estimated at $16,000) be made part of the special assessment and be shared among the three property owners. We feel i; is tm undue burden on us to have to pay the entire cost, while the other properties also receive benefit. We understand that you are requesting a dedication from us for the street right of way. Subject to the approval of our lender (which we are in the process of requesting), we would be willing to make this dedication to the city in order to allow for the construction of the sewer and water systems. We do not support the construction cfa municipal road in this dedication. Furthermore, we request that we not be assessed for any future municipal r6ad construction. The properties that request the road and re.ceive benefit from the road should be responsible for the costs associated with road construction. It is our hope that when the sewer contract is awarded the city will support our request for the contractor to install our water servtce offofFountain Avenue at the same time.
