HomeMy WebLinkAbout02-451.docDECEMBER 10, 2002 02-451 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN ) PURPOSE: MODIFY INSURANCE REQUIREMENTS FOR SPECIAL EVENTS INITIATED BY: CITY ADMINSTRATION WHEREAS, the Common Council for the City of Oshkosh has previously adopted insurance requirements for special events to be held on city-owned property; and WHEREAS, special events held upon city property expose the city to potential claims and liability for accidents arising out of those special events; and WHEREAS, it is advisable to periodically review and update, in consultation with the City's insurance carrier, the City's policies with regard to coverage for special events. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the previous policy specifying insurance requirements for special events is hereby repealed and the attached policy is adopted. BE IT FURTHER RESOLVED that the requirements as specified in the attached policy shall apply to all events, the request or application for which is received after the passage of this resolution. SPECIAL EVENT INSURANCE REQUIREMENTS CITY OF OSHKOSH The term "special event" includes, but is not limited to: outdoor activities, such as boat, bicycle, running or road races, and other forms of competition; music performances or concerts; water ski demonstrations; carnivals; and equipment shows, whether or not alcoholic beverages are served in conjunction with the activity. Athletic events such as softball, soccer, football, baseball, and volleyball. Cultural events, such as art fairs, antique shows, and church services. Activities by private groups or organizations such as classes, meetings, parties, or other gatherings. The term "private event" shall include: private social gathering, not open to the general public; gatherings for family or friends; activities sponsored by private groups or organizations, such as classes, meetings, parties or other gatherings which may be open to the general public, but which may tend to be of interest only to a certain segment of the community (i.e. service organizations, private societies, book clubs, church services or picnics, etc.). The term private event shall not include events such as business or company picnics, or other similar event sponsored or organized relative to businesses or employers. The term city property includes: all municipal buildings, parks, beaches, athletic fields and complexes, streets and other rights of way, parking lots, boating and docking facilities, convention facilities, and any other property owned, leased or controlled by the City of Oshkosh. INSURANCE REQUIREMENTS All sponsors, organizations, or any other person or group scheduling a special event on city property shall procure at their expense, a policy of insurance subject to the following minimum requirements. Sponsors, organizations or any other person or groups scheduling "private events" may be exempted from the requirement to procure a policy of insurance. The decision as to whether insurance shall be required shall be made by the City Manager upon consultation with the Department/Division head and City Attorney. It is hereby agreed and understood that the insurance required by the City of Oshkosh is primary covera,qe and that any insurance or self insurance maintained by the City of Oshkosh, its officers, council members, agents, employees or authorized volunteers will not contribute to a loss. All insurance shall be in full force prior to commencing the event and remain in force throughout the entire event, including the clean up period after the event. 1. GENERAL LIABILITY COVERAGE Commercial General Liability (a) $1,000,000 general aggregate (b) $1,000,000 products - completed operations aggregate (c) $1,000,000 personal injury and advertising injury (d) $1,000,000 each occurrence limit B. Claims made form of coverage is not acceptable. C. Insurance must include the following: (a) be Participants in contents sponsored by the special events host(s) cannot eliminated or excluded from this insurance requirement (b) Premises and Operations Liability (c) Blanket Contractual Liability (d) Personal Injury (e) Products/Completed Operations (f) The general aq,qre,qate must apply separately to this event LIQUOR LIABILITY - If the event holder is selling alcoholic beverages then Liquor Liability with the following limit and coverage must be carried: A. Limits - $500,000 each occurrence/S500,000 aggregate 3. BUSINESS AUTOMOBILE COVERAGE - IF THE EXPOSURE EXISTS: OR Limits - $250,000 each person/S500,000 each accident for Bodily Injury and $100,000 for Property Damage $500,000 Combined Single Limit for Bodily Injury and Property Damage each accident Must cover liability for "Any Auto" - including Owned, Non-Owned and Hired Automobile Liability 4. WORKERS COMPENSATION AND EMPLOYERS LIABILITY- If required by Wisconsin State Statute or any Workers Compensation Statutes of a different state. Must carry coverage for Statutory Workers Compensation and Employers Liability limit of: $100,000 Each Accident $500,000 Disease Policy Limit $100,000 Disease - Each Employee 5. AIRCRAFT LIABILITY (including helicopter) - Owned, Non-Owned or hired. If this exposure shall exist, the limits must be at least $5,000,000 combined single limit For bodily injury (injury passenger liability) and property damage. B. Any liability exclusions relating to slung cargo must be deleted. 6. ADDITIONAL PROVISIONS *Additional Insured - On the General Liability Coverage, Business Automobile Coverage, Aircraft Liability and Liquor Liability. City of Oshkosh, and its officers, council members, a.qents, employees, and authorized volunteers shall be Additional Insureds. *Notice NOTE: City of Oshkosh requires 30 day written notice of cancellation, non-renewal or material change in the insurance coverage. *The insurance coverage required must be provided by an insurance carrier with the "Best" rating of "A- - VII" or better. All carriers shall be admitted carriers in the State of Wisconsin. *The Certificate of Insurance shall be satisfactory proof of issuance of said policies and shall be filed at the office of the City Clerk for the City of Oshkosh a minimum of five ($) days prior to the scheduled event. A copy of the Certificate of insurance may be accepted by facsimile transmission with the original to be received no later than three (3) days prior to the event. If these requirements are not met, the event cannot be held on City Property. Special Events Insurance Requirements 12-10-02
