Resolution 02-450 Resolution 02-451 O./HKQ/H ON THE WATER REGULAR MEETING held Tuesday, December 10, 2002 at 6:00 p.m. in the Council Chambers, City Hall. Mayor Hintz presided. PRESENT: Council Members Paul Esslinger, Mark Harris, Shirley Mattox, William Castle, Jon Dell'Antonia, Frank Tower and Stephen Hintz ALSO PRESENT: Richard Wollangk, City Manager, Pamela Ubrig, City Clerk, Warren Kraft, City Attorney and David Patek, Director of Public Works Council Member Tower read the Invocation. The Pledge of Allegiance was led by Katie Blando and Katie Reed from St. Frances Cabrini Elementary School. The Chief of Police presented a plaque to the Laux Agency for the new design of the patch for Oshkosh Police Department. Consent Agenda The minutes of the November 26, 2002 meeting were presented as written. The Report of the City Manager was read. The bills were presented in the amount of $7,886,234.56. The Report of the City Clerk was read. Resolution 02-449 Grant Conditional Use Permits: A) 338 N. Eagle Street B) N. Washburn Street, N. of & Adjacent to 275 N. Washburn Street Council Member Mattox expressed her concerns regarding the landscaping of 338 N. Proceedings of the Common Council -December 10, 2002 Mayor Hintz questioned the insurance requirements for special events in the various areas of the community. Mr. Kraft responded. Council Member Mattox questioned what affect the zone change would have on the business of Mr. Hergert. Council Member Esslinger questioned if the request could be brought before the Zoning Appeals Board. Mr. Wollangk responded. Ordinance 02-462 Create Humane Officer Position/Establish Abatement Procedure Ken Bender, 806 Oak Street, questioned if the position was held with existing personnel just changing their title or was it a new position. Mayor Hintz responded. Mr. Wollangk responded. Council Member Dell'Antonia explained that the Planning Commission would take a look at the project again and it would come back to the Council for approval. He explained that with the amendment the project would get started. Ordinance 02-461 Approve Zone Change/west side of N. Main Street, north of Libbey Avenue MOTION: ADOPT (Dell'Antonia; second, Esslinger) CARRIED: Ayes (7)Tower, Esslinger, Harris, Mattox, Castle, Dell'Antonia, Hintz Proceedings of the Common Council -December 10, 2002 Mayor Hintz questioned if the zone changed was approved how it would affect future development and the land immediately north. Mr. Wollangk responded. Council Member Dell'Antonia explained that the adjacent property was not in the city therefore future development was uncertain. Ordinance 02-462 Create Humane Officer Position/Establish Abatement Procedure FIRST READING; LAID OVER UNDER THE RULES Resolution 02-463 Authorize Police Department Grants/C.A.R.D. & Bicycle Safety MOTION: ADOPT (Castle; second, Tower) CARRIED: Ayes (6)Tower, Harris, Mattox, Castle, Dell'Antonia, Hintz; Noes (1) Esslinger Council Member Esslinger explained the grants and stated he would not support the resolution. Mr. Wollangk responded. Citizen Statements Ken Bender, 806 Oak Street, expressed his concerns regarding safety at the driveway on Wisconsin Street by the new development. Robert Mugerauer, 727 Florida Avenue, expressed his concerns regarding street improvements. Mr. Wollangk responded. Council Member Mattox questioned if the street improvements on Florida Avenue could be completed earlier than planned. Mr. Patek responded. Council Member Dell'Antonia explained that the street improvements scheduled for next year could be looked at but choices would have to be made. Robert Cornell, 548 W. Smith Avenue, thanked the city staff for their prompt attention to 4 various issues. He also suggested paying water bills electronically and on a monthly basis instead of quarterly. Proceedings of the Common Council -December 10, 2002 Council Member Dell'Antonia questioned when water bills would be on a monthly basis. Mr. Wollangk responded. Gordon Doule, 1225 Summit Avenue, expressed his views regarding city staff job descriptions. COUNCIL MEMBER STATEMENTS Council Member Harris expressed his thoughts and concerns regarding the Westhaven Bridge and the potential traffic lights. Mr. Wollangk responded. Council Member Esslinger expressed his concerns regarding safety issues with new streets and street improvements. Mr. Wollangk responded. Council Member Dell'Antonia reminded the citizens of the opportunity to enjoy the holiday lights at the various parks. Council Member Mattox thanked the volunteers that participated in the Sites of the Season and the local paper for the publicity. There was no other business before the Council.
