AMEND SPECIAL ASSESSMENT POLICY
COUNCIL MEMBERS HARRIS and TOWER
BE IT RESOLVED by the Common Council of the City of Oshkosh that the following
amendment to the Special Assessment Policy is approved:

Delete:
11.
For paving in residential zoned areas, the assessment rate for frontage shall not
exceed 1/3 of the assessable construction cost divided by the total assessable
frontage feet. For 32-feet wide f-f concrete pavement in residential zoned areas
during the 1999 construction season, the assessment rate shall not exceed $31.30
per lineal foot. For the years 2000, 2001, and 2002, the assessment rate shall not
be increased by more than 15% per year. (Res. #99-393 & Res. #00-37)
Replace with:
11. For paving in residential zoned areas, the assessment rate for frontage shall not
exceed 1/3 of the assessable construction cost divided by the total assessable
frontage feet. For 32-feet wide f-f concrete pavement in residential zoned areas
during the 2002 construction season, the assessment rate shall not exceed $47.60
per lineal foot. For subsequent years, the assessment rate shall not be increased
by more than 15% per year. (Res. #99-393, Res. #00-37 & Res. #02-423)

For concrete paving in other than residentially zoned areas during the 1994
construction season, the assessment rate shall not exceed $52.50 per lineal foot.
For all years after 1994, the assessment rate shall not be increased by more than
10% per year for the following five years. Further, if a petition for other than
residentially zoned street improvement is received and the City is unable to
construct the project in the following construction season, the assessment rate for
the other than residentially zoned property shall be held at the rate calculated for
the construction season following receipt of the petition regardless of the rate
established for the particular year of construction. (Res. #93-306)

BE IT FURTHER RESOLVED that these changes shall be effective for all projects
beginning on or after the date of passage and publication of this resolution.
