HomeMy WebLinkAbout02-400.docNOVEMBER 12, 2002 02-400 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN PURPOSE: SET PUBLIC HEARING DATE TO VACATE PORTION OF MARION ROAD AT ITS INTERSECTION WITH WISCONSIN STREET INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved WHEREAS, it appears that the public interest requires that that portion of the following described street or alley within the City of Oshkosh be vacated and discontinued: Portion of Marion Road at its intersection with Wisconsin Street (as described in the attached "Exhibit A") NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that a hearing on the passage of the following resolution shall be held before the Common Council in the Council Chambers in the City Hall, City of Oshkosh, Winnebago County, Wisconsin, on Tuesday, January 14, 2003 at 6:00 PM of said day and the proper City officials are hereby authorized and directed to give notice of said hearing by personal service and publication of said hearing as provided by law. BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh pursuant to Section 66.1003(4) of the Wisconsin Statutes, that it is hereby declared that since the public interest requires it, that portion of the following described street or alley within the City of Oshkosh, Winnebago County, Wisconsin, be vacated and discontinued: Portion of Marion Road at its intersection with Wisconsin Street (as described in the attached "Exhibit A") "EXHIBIT A" Marion Road 15-foot wide Street Vacation Legal Description Being a part of Marion Road in Block N of Western Addition, a recorded subdivision, being a part of the Southeast 4¼ of the Northeast 4¼ and a part of the Southwest 4¼ of the Northeast 4¼, in Section 23, Township 18 North, Range 16 East, City of Oshkosh, Winnebago County, Wisconsin, bounded and described as follows: Commencing at the southeast corner of said Northeast lA Section; thence North 01017'08'' West, 233.67 feet along the east line of said Northeast 4¼ Section to the centerline of Pearl Avenue as established from the centerline of the existing pavement between Dawes Street and Jackson Street; thence North 53002'34'' West, 1008.36 feet along said centerline to the northeasterly extension of the centerline of vacated Dawes Street, to an angle point, and to the centerline of Pearl Avenue as established from the centerline of the existing pavement from to Dawes Street to Pearl Avenue to the centerline of Wisconsin Street as established from the centerline of the existing pavement; thence South 52046'05'' East, 33.00 feet; thence North 88029'36'' East, along the westerly right of way of proposed Warren Road, 12.82 feet; thence South 53014'49'' East, along said westerly right of way of proposed Warren Road, 310.01 feet to the northerly right of way of proposed Marion Road; thence South 36045' 11" West along said right of way, 463.78 feet to a point being on the northeasterly right of way of Marion Road and also the point of beginning; Thence South 36°45'11" West, along an extension of the northerly right of way of proposed Marion Road, 15.05 feet; thence North 48°40'13" West, along a parallel to the northeasterly right of way of existing Marion Road, 297.20 feet to a point on the southeasterly right of way of Wisconsin Street; thence North 43024'54'' East, 15.01 feet along said right of way of Wisconsin Street; thence South 48°40'13" East, along the northeasterly right of way of existing Marion Road, 295.45 feet to the point of beginning. Above described parcel of land having an area of 4,445 square feet or 0.1020 acres.
