REQUEST FOR ADDITIONAL INFORMATION

The submittal described above has been placed on HOLD and the review and approval is pending subject to receipt of the
ADDITIONAL INFORMATION and/or revised plans requested by this letter. Upon receipt of the additional information and/or
revised plans, the plans will be reviewed for compliance to applicabl e Wisconsin Administrative Codes and Wisconsin Statutes.
The KEY ITEM(S) must be corrected/revised and accompany the resubmittal. In your submittal, include a copy of this letter
utilizing the checkboxes to indicate completed items. You will have one opportunity to address ALL the items in this letter and
your response must be submitted within 15 business days of the date of this correspondence, or this submittal will be returned
DENIED.
KEY ITEM(S):
SPS 302.31(1)(f) - Revised plans are required to be submitted to address the plan review comments and HOLD email. The fee
for a plan re-submittal received prior to a denial action is $75 + $100 submittal fee = $175. Include electronic index sheets
showing plan sheet revision dates, or update and/or include additional electronic files with their revision date on each. The
index shall be properly stamped and signed by the licensed Wisconsin professional that prepared the plans, or each of the
revised sheets shall be stamped, signed and dated by the licensed Wisconsin Professional if required by SPS 361.31(1). The
revised submittal shall be one bound electronic set in accordance with SPS 361.31 (2)(b).
A petition for variance has been submitted for review. The petition involves concerns relating to IBC 406.3.6 which involves Private
garages and carports. IBC 406.3.5 addresses Carports, and IBC 406.3.6 addresses automatic garage door openers. Specifically, the
code states, “Automatic garage door openers, where provided, shall be listed in accordance with UL 325.” UL 325 addresses the
automatic operation of garage doors and contains the provisions related to the automatic operation of gates. It is important to note
that all gates included in UL 325 are defined as vehicular gates and not pedestrian gates. Property owners are expected to provide a
separate entrance for pedestrian access.
The submitter states, “There is an existing motorized slide gate separating the west and east half of the institution. The gate is
normally open allowing both inmates and personnel to move between both sides. Certain critical situations require that the gate is
closed/locked remotely from a tower that has a direct line of site. The location does not impact or prevent the safe exit of any
building or the institution if necessary. Motorized operation of this gate from the guard tower is critical of safety of OCI staff…”
The submitted petition states, “Contractors have refrained from bidding on a project to replace the existing gate operator because it
is being used primarily as a pedestrian gate. Their reasoning is that the (gate) operator is classified under UL 325 which covers

vehicular gates only…There are two existing pedestrian gates located south of this motorized gate but they are normally closed and
are manually operated.”
There is confusion as to the submitted petition’s reference to the IBC 1010.1.9.6. That section addresses controlled egress doors
located within Group I-1 & I-2 occupancies. Under Item 8, “The door locking system units shall be listed in accordance with UL
294.” Is it the intent to replace the UL 325 requirement referenced under IBC 406.3.6 with that of the UL 294 as referenced in IBC
1010.1.9.6?
In review of your petition, your request for action by the Department is in question. Is it the submitter’s intent, via the submittal of
this petition to:
1) Request to apply UL 325 to the proposed gate installation knowing that the use of the gate is primarily used as pedestrian gate;
OR
2) Eliminate the application of UL 325 to the gate of concern with no replacement standard; OR
3) Eliminate the application of UL 325 and apply the requirements of UL 294; OR
4) Take actions other than those identified here?
The submitted petition is not definitive as to what actions are being requested to take place, nor how equivalent safety will be retained
if the UL 325 standard is retained or eliminated. Since this is a petition for variance, justification and related clarifications shall be
provided to the Department in writing. Verbal discussion can be made, but will not be recognized for use in addressing th is petition
inquiry.

If the above requested information and/or plans are not received within 15 business days of the date of this correspondence, this
submittal will be returned DENIED. No fees will be refunded, and a new fee, application form, and submittal of plans/specifications
will be required should you desire to continue with this project. The code in effect at the time of new submittal would apply .
