PURPOSE: FLOODPLAIN MAP AMENDMENT/NORTHSHORE PRESERVE PLAT INITIATED BY: OMNNI ASSOCIATES, PETITIONER; NORTHSHORE REAL ESTATE DEVELOPMENT LLC, OWNER PLAN COMMISSION RECOMMENDATION: Approved WHEREAS, a survey prepared by Omnni Associates, a Wisconsin Registered Land Surveying company, for Lots 34, 35, 38 and 39, Northshore Preserve Plat, City of Oshkosh, Winnebago County, Wisconsin, indicates a portion of said properties are mapped as floodplain; and WHEREAS, the property owner certifies that said property will be filled to the elevations set forth in the attached map and that said elevations are above the regional floodplain elevation of 750.0 ft., and that said property is contiguous to land outside the floodplain; and WHEREAS, based on these elevations, the property owner requests that approximately 28,000 sq. ft. of area on said parcels, per the attached map, be removed from the Floodplain Zoning Map; and WHEREAS, a public hearing, after due and proper notice was held before the Common Council of the City of Oshkosh concerning said amendment to the Floodplain Zoning Map for the City of Oshkosh, and the Plan Commission having recommended the adoption of this Ordinance. NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. Based on the information submitted by the property owner, it is determined that approximately 28,000 sq. ft. of area, per the attached map, is hereby removed from the Floodplain Zoning Map. SECTION 2. This amendment is contingent upon the property owner obtaining all appropriate approvals from the Wisconsin Department of Natural Resources, and the filing of a certification of fill placement and map with the City of Oshkosh. SECTION 3. This Ordinance shall be in effect upon its passage and publication and upon final approval by the Wisconsin Department of Natural Resources.
