PURPOSE:
GRANT CONDITIONAL USE PERMITS:
(A) 305 CEAPE AVENUE/10 COURT STREET
(B) W. 9TH AVENUE
(C) 1530 S. KOELLER STREET
(D) 1530 S. KOELLER STREET
INITIATED BY:
(A) WISCONSIN PUBLIC SERVICE; (B) NEW LIFE COMMUNITY
CHURCH; (C) COMMUNITY FIRST CREDIT UNION;
(D) CITIZENS FIRST CREDIT UNION
PLAN COMMISSION RECOMMENDATION: All found consistent with Standards set forth in
Section 30-11 (D) of the Zoning Ordinance and approved w/conditions as noted
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted under Section 30-11 of the Oshkosh Zoning
Ordinance for the following properties, and that said permits are granted with conditions,
if any, as noted for each respective property.
A) 305 Ceape Avenue/10 Court Street; Wisconsin Public Service Corp. (WPSC)
A conditional use permit for the temporary operation of a thermal treatment plant/unit,
per the attached "Exhibit A", with the following conditions:

The thermal treatment plant be removed within 60 days after the thermal
treatment part of the remediation work plan has been completed.
All excess debris generated as part of the remediation process be removed from
site when remediation has been completed.
WPSC will be responsible for controlling dust, odor, noise and any other health
related concerns associated with operation of the thermal treatment plant and
related remediation activities.
That WPSC indemnify and hold harmless the City of Oshkosh from any claims
arising from the operation of the thermal treatment plant and related remediation
activities, in accordance with an agreement to be approved by the City Attorney's
Office.
That WPSC comply with all requirements of the State of Wisconsin Department
of Natural Resources, obtain necessary approvals in that regard, and comply
with any other ordinances or governmental entities.

B) W. 9th Avenue; New Life Community Church
A conditional use permit for construction of a 35,000 sq. ft. structure to include church
offices, a gathering/worship area, a hospitality area and a children's day care center, per
the attached "Exhibit B", with the following conditions:

A landscape plan be submitted to, and approved by, the Department of
Community Development prior to the issuance of a building permits.
Subject property is limited to the Zoning Ordinance allowed signage identified in
Section 30-37 of the Ordinance.
An additional 7 feet of right-of-way be dedicated to allow for 40 feet of right-of-
way north of the centerline of 9th Avenue prior to the issuance of a building
permit.
The day care center be limited to a license capacity of 75 children with
operations Monday through Friday from 6:30 am to 5:30 pm.
Fenced area for enclosure of the playground be solidly screened or landscaped.
Future expansion plans be undertaken in conformance with the submitted site
plan.
C) 1530 S. Koeller Street; Community First Credit Union
A conditional use permit to hold two temporary automobile sales events, one for 3 days
in March, 2002 and one for 3 days in September, 2002, per the attached "Exhibit C",
with the following conditions:

All signage to be placed on the site be placed in compliance with the Zoning
Ordinance and require a building permit prior to placement.
No signage shall be placed on the site prior to seven (7) days before the actual
event occurs.
All signage to be removed within one (1) day after the sale has ended.
The sales event to be held over only 3 days each in March and September,
2002.
Vehicles cannot be placed on the site prior to seven (7) days before the event
begins and removed by the Saturday following the event.
Vehicles to be placed inside the building are to be placed in compliance with
applicable building and fire code requirements.
D) 1530 S. Koeller Street; Citizens First Credit Union
A conditional use permit to hold two temporary automobile and boat sales events, one
for 3 days in March, 2002 and one for 3 days in October, 2002, per the attached "Exhibit
D", with the following conditions:
