Mayor Dell'Antonia presided. PRESENT: Council Members Stephen Hintz, Shirley Mattox, William Castle, Mark Harris, Paul Esslinger, Melanie Bloechl and Jon Dell'Antonia ALSO PRESENT: Richard Wollangk, City Manager, Pamela Ubrig, City Clerk, Warren Kraft, City Attorney and David Patek, Director of Public Works Council Member Hintz read the Invocation. The Pledge of Allegiance was led by Michael Thiel from Perry Tipler Middle School. CONSENT AGENDA The minutes of the January 8, 2002 meeting were presented as written. The Report of the City Manager was read. The bills were presented in the amount of $18,590,332.94. The Report of the City Clerk was read. Resolution 02-17 Grant Conditional Use Permit/490 N. Campbell Road Resolution 02-18 Authorize Jurisdictional Offers/S. Koeller Street Resolution 02-19 Resolution of Support for Wisconsin Department of Commerce Technology Zone Council Member Bloechl stated her concerns with the lack of information regarding the technology zone. She stated she would not support the resolution. Resolution 02-20 Waive Bids & Purchase Personal Computers/MIS Department (Paragon Development Systems, Oconomowoc $54,634.00) Resolution 02-21 Approve Agreement with Winnebago County/Inter-Agency Agreement for Level "B" Hazardous Material (HAZMAT) Response Service PROCEEDINGS OF THE OSHKOSH COMMON COUNCIL -- JANUARY 22, 2002 Resolution 02-22 Approve Amendment No. 3/Contract/Sawyer Street Bridge Rehabilitation Resolution 02-23 Approve Change Order No. l/Public Works Contract No. 01- 16 (MCC, Appleton, Increase $1009.13) Resolution 02-24 Endorse State Highway 41 Improvements Robert Kujawa, 504 W. Nevada Avenue, urged the Council to support the resolution. Resolution 02-25 Approve Agreements/Transportation Services/Winnebago County, Lakeside Packaging Plus, Inc. & Zion Eldercare Resolution 02-26 Accept Revised Route Structure Resolution 02-27 Rescind Property Taxes/2700 W. 9th Avenue Resolution 02-28 Distribution of Fisk-Gallup Trust Resolution 02-29 Authorize Police Department Grant/"Teen Buckle Down" Council Member Bloechl expressed her concerns regarding the state grant and stated she would not support the resolution. Council Member Esslinger stated that he would not support the resolution. Resolution 02-30 Disallowance of Claim/Sally DiCianni Resolution 02-31 Approve Miscellaneous City Licenses *Resolutions 02-19, 02-29 and 02-31 were removed for separate consideration. He stated he would not support the resolution. Council Member Esslinger stated his concerns regarding Council making the decision what items should be sold at Wal-Mart. PUBLIC AGENDA DISCUSSION Resolution 02-36 Grant Conditional Use Permit/2318 W. 20th Avenue Wendy Schwalbe, 2387 Allerton Drive, stated her concerns regarding fencing, traffic, and lack of parking. She urged the Council not to support the resolution. Council Member Hintz expressed his concerns regarding traffic and parking issues. Donald Shaw, 2300 W. 20th Avenue, stated his concerns regarding traffic flow and safety issues. He asked the Council to consider these concerns and not to support the resolution. PROCEEDINGS OF THE OSHKOSH COMMON COUNCIL -- JANUARY 22, 2002 Council Member Esslinger questioned if there were any concerns with the noise from the present occupant. Council Member Harris expressed his concerns if another manufacturing company would take over the existing company. Sandy Schuessler, 2395 Allerton Drive, expressed her concerns regarding the day care and how it would affect her property value. Terry Jokipii, 2885 Oakwood Lane, explained she was willing to work with neighbors. She stated the hours could be revised and the parking issue had been looked at. Council Member Bloechl questioned the location of the day care and if the property owner was looking to relocate. She stated her concerns for handicap requirements and staffing. Council Member Mattox stated her concerns regarding the noise and traffic levels. She questioned if there was another location that would be appropriate. Barbara McClain, 1534 Jackson Street, real estate agent, commented on other locations in the area and the need for day care. Jim Bruggeman, 4999 Washington Boulevard, Butte Des Morts, representing Adashun Jones commented on the property. TO 6:00 P.M. (Esslinger; second, Castle) CARRIED: Ayes (6) Hintz, Mattox, Castle, Harris, Esslinger, Dell'Antonia; Noes (1) Bloechl VOTE ON RESOLUTION AS AMENDED: LOST: Ayes (3) Harris, Esslinger, Dell'Antonia; Noes (4) Hintz, Mattox, Castle, Bloechl Council Member Bloechl expressed her concerns regarding the need for a day care but felt that the location was not appropriate. Council Member Mattox stated her concerns regarding the location of the day care. Mayor Dell'Antonia commented that the day care would be a good addition to the neighborhood. CITIZEN STATEMENTS Daniel Lynch, 310 S. Eagle Street, expressed his concerns regarding students smoking. Gordon Doule, 1221 Summit Avenue, expressed his concerns with road rage and that laws were being violated. Ken Bender, 806 Oak Street, stated his concerns with the downtown improvements and the need for a conservative approach to spending. Don Tripp, 2336 Wisconsin Street, expressed his concerns with the collection of recyclables for condominiums. COUNCIL MEMBER STATEMENTS Council Member Esslinger commented on the raising of forfeiture fees. Mr. Kraft responded. Council Member Bloechl expressed her concerns regarding the Governor's budget plan. Council Member Mattox expressed her concerns regarding snow removal at bus stops. PROCEEDINGS OF THE OSHKOSH COMMON COUNCIL -- JANUARY 22, 2002 Council Member Harris commented on Mr. Lynch's smoking campaign. He also expressed his concerns with students walking to the YMCA without sidewalks on 20th Avenue. Council Member Castle questioned staff about a boat-launching fee. Mayor Dell'Antonia explained the various buildings that were being torn down and Aurora building a new hospital. WHATEVER ELSE IS PERTINENT OR FOR THE GOOD OF THE CITY Mr. Wollangk stated there would be a workshop on February 5, 2002 to discuss budget issues. He expressed his concerns regarding the new proposal by the Governor and urged citizens to call their legislatures. MOTION: CONVENE INTO CLOSED SESSION FOLLOWING AJOURNMENT OF THIS MEETING TO DISCUSS THE STATUS PRESENT AND PRESPECTIVE FOR DELIBERATING AND NEGOTIATING VARIOUS AGREEMENTS REGARDING 1 & 2 N. MAIN STEET PURSUANT TO SECTION 19.85(1)(e) OF THE WISCONSIN STATUES AND TO CONFER WITH LEGAL COUNSEL REGARDING STRAGEDY TO BE ADOPTED WITH RESPECT TO LITIGATION CONCERNING 1 & 2 N. MAIN STREET PURSUANT TO SECTION 19.85(1 )(g) OF THE WISCONSIN STATUES.
