HomeMy WebLinkAbout01-525.docDECEMBER 11, 2001 FIRST READING DECEMBER 26, 2001 SECOND READING 01-503 01-525 ORDINANCE (CARRIED 6-0 LOST LAID OVER WITHDRAWN ) PURPOSE: LESNICK ANNEXATION INITIATED BY: TIMOTHY LESNICK ETAL PLAN COMMISSION ACTION: Approved A GENERAL ORDINANCE OF THE CITY OF OSHKOSH ANNEXING CERTAIN TERRITORY IN THE CITY OF OSHKOSH AND SPECIFICALLYTO THE 12TH WARD OF SAID CITY. WHEREAS, an annexation petition duly circulated has heretofore been signed by the owners of more than 50% of the land in the area within such territory, and a majority of the electors residing in said territory, notice of intention to circulate an annexation petition for direct annexation having been duly published, and a copy of said notice with a scale map reasonably showing the boundaries of the area sought to be annexed and its relation to the municipalities involved, having been duly served upon the affected municipal and school district clerks and the Director of the Municipal Boundary Review of the State of Wisconsin, Department of Commerce within five (5) days of the date of publication of said notice, adoption of this Ordinance shall constitute acceptance of the petition of annexation; and WHEREAS, more than twenty (20) days have lapsed since the publication of the notice of intention to circulate such annexation petition and not more than one hundred twenty (120) days have lapsed since the filing of the annexation petition; and WHEREAS, the Director of the Municipal Boundary Review of the State of Wisconsin, Department of Commerce has issued his opinion that the annexation is not contrary to the public interest; and WHEREAS, the Plan Commission of the City of Oshkosh has recommended that said property be temporarily zoned as follows: A-1 Light Agricultural NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: DECEMBER 11, 2001 FIRST READING DECEMBER 26, 2001 SECOND READING 01-503 01-525 ORDINANCE CONT'D SECTION 1. The following described territory, pursuant to a duly circulated and filed annexation petition for direct annexation is hereby annexed to and made part of the City of Oshkosh, a municipal corporation located in Winnebago County, more specifically in the 12th Ward of said City, and subject to all the laws governing the same, all in accordance with Section 66.0217 of the Wisconsin Statutes and the amendments thereto: as described in the attached "Exhibit A" SECTION 2. Sections 1-28 and 1-29 of the Oshkosh Municipal Code pertaining to Boundaries, Wards, Polls, Benchmarks are hereby amended so as to reflect the provisions of this Ordinance and the proper City officials are hereby authorized and directed to make such changes. SECTION 3. The proper City officials are hereby authorized and directed to comply with the following requirements of Section 66.0217(9) of the Wisconsin Statutes and the City Clerk shall give written notice to the appropriate Town Clerk of the acceptance of the annexation petition and the adoption of this Ordinance. SECTION 4. Said property hereinabove described is hereby temporarily zoned as follows: A-1 Light Agricultural SECTION 5. This Ordinance shall be in full force and effect from and after its passage and publication. "EXHIBIT A" LESNICK ANNEXATION All of the SW ¼ of the NW ¼, and all of the SE ¼ of the NW ¼ and parts of the SW ¼ and the SE ¼ of the NE ¼ and parts of the NW ¼, NE ¼, SW ¼ and SE ¼ of the SW ¼ all in Section 34, T19N, R16E, in the Town of Oshkosh, Winnebago County, Wisconsin, described as follows: Beginning at the west ¼ corner of said Section 34; thence N. 89°54'45'' E., 33.00 feet to the east line of County Road T; thence N. 89°54'45'' E., 600 feet along the north line of the NW ¼ of the SW ¼ of said Section 34; thence S. 00°34'51" W., 903.97 feet to the northerly line of State Road "110"; thence southeasterly 667.14 feet along the northerly line of State Road "110" and being a curve of 2,342.01 feet radius whose center lies to the southwest and whose chord bears S. 34°49'55'' E., 664.89 feet; thence S. 26°40'17'' E., 250.48 feet along the northerly line of State Road "110" to beginning of a meander line running approximately along the northwesterly shoreline of Slough Creek, said point of beginning being 88 feet more or less westerly of the shoreline of Slough Creek; thence N. 59°54'10" E., 842.69 feet; thence N. 67°39'12'' E., 404.66 feet; thence N. 14°10'46'' W., 205.67 feet; thence N. 14°38'08'' W., 270.93 feet; thence N. 25°32'05'' E., 784.61 feet; thence N. 52°04'14'' E., 169.53 feet; thence N. 74°28'16'' E., 161.97 feet; thence S. 76°38'42'' E., 326.08 feet; thence N. 67°57'45'' E., 88.73 feet; thence N. 54°04'33'' E., 739.64 feet; thence N. 42°05'08'' E., 276.72 feet; thence N. 65°40'40'' E., 266.50 feet; thence N. 49°07'14'' E., 273.32 feet; thence N. 14°51'58'' E., 243.22 feet to a point on the north line of the SE ¼ of the NE ¼ of said Section 34 and to the end of said meander line, said end point being 20 feet more or less from the shoreline of Slough Creek; thence S. 89°54'15" W., 1,763.48 feet along the north lines of the SE ¼ of the NE ¼ and SW ¼ of the NE ¼ of said Section 34 to the northwest corner of the SW ¼ of the NE ¼ of said Section 34; thence S. 89°53'42'' W., 2,616.57 feet along the north lines of the SE ¼ of the NW ¼ and the SW ¼ of the NW ¼ of said Section 34 to the east line of County Road T; thence S. 89°53'42'' W., 33.00 feet to the northwest corner of the SW ¼ of the NW ¼ of said Section 34; thence S. 00°29'08'' W., 1,334.25 feet along the west line of the SW ¼ of the NW ¼ of said Section 34 to the W ¼ corner of said Section 34 being the point of beginning. Also included are all lands lying between the above-described meander line and the centerline of Slough Creek and all lands southeast of the centerline of Slough Creek in the SE ¼ of the NW ¼ of said Section 34. Said parcel contains approximately 171.3 acres.
