PURPOSE: GRANT CONDITIONAL USE PERMITS; APPROVE FINAL PLANNED DEVELOPMENTS: (A) WISCONSIN STREET; VACANT LOT (B) 3265-3285 S. WASHBURN STREET (C) 3911 S. WASHBURN STREET (D) DIVISION STREET, VACANT LOT SOUTH OF 420 DIVISION STREET INITIATED BY: (A) D & F INVESTMENTS, PETITIONER; (B) BERGSTROM AUTOMOTIVE; (C) ROBERT MAZZA; (D) KITZ & PFEIL PLAN COMMISSION RECOMMENDATION: All approved BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional use permits are hereby granted for the following properties under Section 30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as noted for each respective property, and the Planned District Overlay and final development plans, per the attached exhibits, are hereby approved. A) Wisconsin Street, vacant lot SE Corner Wisconsin Street & Pearl Avenue; D & F Investments, petitioner A conditional use permit for a planned commercial development to construct a multi- tenant commercial building to be completed in phases, per the attached "Exhibit A", with the following conditions: 1) 2) 3) 4) A base standard modification to the Zoning Ordinance to allow for an encroachment of the proposed parking and dumpster areas along Marion Road is allowed as requested on the submitted site plan. A detailed landscaping plan be submitted to, and approved by, the Department of Community Development prior to issuance of a building permit. Details and final locations of the decorative fencing is subject to approval by the Department of Community Development. Installation of all signage on the site and building be subject to approval by the Department of Community Development. The maximum width of the driveway on Wisconsin Street be limited to 12-14 feet in width at the lot line with final width subject to review and approval of the Department of Public Works. The petitioner is responsible for closing the existing driveway openings on Wisconsin Street. Southwest bound traffic lane designations along Wisconsin Street be changed to make the right lane a through lane and the left lane a left turn lane with final locations determined by the City. Final detail of the dumpster enclosures be consistent with the building faCade and subject to approval by the Department of Community Development. Screening detail be provided for on site utilities and utility penetrations, particularly meter sockets, prior to issuance of a building and/or occupancy permit. Lighting and exterior lighting details on site and on the building is subject to approval by the Department of Community Development prior to installation. Should the Phase II development as proposed not occur within 18 months of occupancy of Phase I, revisions to the landscaping, site, and building plan be subject to review and approval by the Department of Community Development. Final review of faCade materials and colors is subject to review and approval by the Department of Community Development prior to installation. B) 3265-3285 S Washburn Street; Bergstrom Automotive, owner A conditional use permit for expansion of an existing planned commercial development to construct (a) an addition for an employee break room; (b) an addition consisting of four service bays and detail wash bays; and (c) a new building for a used car facility to the north of the existing facility, per the attached "Exhibit B", with the condition that no base standard modifications to the Zoning Ordinance relative to the proposed development plan are allowed. C) 3911 S. Washburn Street; Robert Mazza, owner A conditional use permit for a planned commercial development for construction of an oval dirt track for racing radio controlled cars and an observation deck, per the attached "Exhibit C", with the condition that the permit be valid until January 1, 2004 when the development plan will again be reviewed. D) Division Street; vacant lot south of 420 Division Street; Kitz & Pfeil, owner A conditional use permit for an open storage area, per the attached "Exhibit D".
