PURPOSE:
AMEND RECYCLING PROGRAM
INITIATED BY: CITY ADMINISTRATION
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 23 OF
THE OSHKOSH MUNICIPAL CODE PERTAINING TO RECYCLING.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 23-1(F) of the Oshkosh Municipal Code 3ertaining to
definitions - Institutional be repealed and recreated to read as follows:
(F)
"Institutional" means a non-profit establishment for public use including but
not limited to the following: structures owned or operated by the county, state
or federal government, or any subdivision thereof, excluding property owned
or operated by the City of Oshkosh; a University school, hospital; church; or
care facility for the elderly or disabled.
SECTION 2. That Section 23-7 of the Oshkosh Municipal Code pertaining to
recycling be repealed and recreated to read as follows:
Section 23-7 Standard of Service
(A) Residential Areas
(1)
Solid waste, with the exception of recyclable materials, shall be
collected once a week from residential dwelling units according to a
schedule set by the City.
(2)
Recyclable materials shall be collected from residential dwelling units
according to a schedule set by the City.
(3)
The City will pick up plaster and building materials at a frequency not
exceeding once per month from residential dwelling units, provided
that the total amount does not exceed 32 gallons in capacity and is
placed in containers, the gross weight of which does not exceed 50
pounds.

(B) Multiple Dwellinq Units
(1)
Solid waste, with the exception of recyclable materials, shall be
collected once a week from multiple dwelling units according to a
schedule set by the City.
(2) The City shall collect no recyclable materials from dwellings
containing four or more multiple dwelling units.
(3) Recyclable materials shall be kept separate from other solid waste.
(C) Commercial, Institutional and Industrial Units
(1)
Solid waste, with the exception of recyclable materials, shall be
collected from commercial, institutional and industrial establishments
once each week according to a schedule set by the City and the
amount of collection shall not exceed two (2) cubic yards per week.
Any such establishment accumulating or generating more than a total
of two (2) cubic yards of solid waste shall not receive a pickup from
the City and must arrange for disposal of all its solid waste.
(2)
The City shall collect no recyclable materials from commercial,
institutional and industrial establishments.
(2) Recyclable materials shall be kept separate from other solid waste.
SECTION 3. That Section 23-9 (A), (B), (E) (1) and (E) (2) (b) of the Oshkosh
Municipal Code pertaining to General Requirements shall be amended to change the
capacity of containers and bags from not to exceed thirty (30) gallons to not to exceed
thirty-two (32) gallons.
SECTION 4. That Section 23-9(E)(2)(b) second unnumbered paragraph shall be
repealed.
SECTION 5. That Section 23-9 (F) of the Oshkosh Municipal Code pertaining to
General Requirements - Recyclables City drop-off site shall be repealed.
SECTION 6. That Section 23-13 of the Oshkosh Municipal Code pertaining to
Private Collections be repealed and recreated to read as follows:

on a revocable basis, to collect refuse at no cost to the City, providing that such collection
is performed in accordance with the provisions of this Chapter and produces no
objectionable conditions in and on the streets of the City.
Any commercial, industrial or institutional establishment who accumulates or generates
more than two (2) cu. yards of solid waste per week shall arrange for collection of solid
waste by a private carrier.
SECTION 7. This ordinance shall be in full force and effect from and after its
passage and publication for all collections occurring on or after January 1, 2002.
