PLAN COMMISSION RECOMMENDATION: All approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted for the following properties under Section
30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with
conditions, if any, as noted for each respective property, and the Planned District
Overlay and final development plans, per the attached exhibits, are hereby approved.
A) 1965 Oshkosh Avenue; US Cellular, petitioner
A conditional use permit for a planned commercial development to construct a 120 ft.
high monopole with associated antenna and a 12' x 20' equipment shelter enclosed by
an 8 ft. high chain link fence, per the attached "Exhibit A", with the condition that an
enhanced level of landscaping around the building and parking lot perimeter be
provided in order to effectively screen the cellular tower compound from street view.
B) 960 N. Koeller Street/1965 Oshkosh Avenue, Father Carr, owner/petitioner
A conditional use permit for expansion of an existing planned development for
construction of a 3 story 82 unit limited stay facility, to include but not limited to, a
basketball court, a soup kitchen and food pantry, and detached garages, as well as
parking and ground signs, per the attached "Exhibit B", with the following conditions:

1) The exterior of the limited stay facility be a combination of steel siding and brick
material that matches the facade material of the approved Bethlehem Inn facility already
under construction on the site.
2) A landscape plan be submitted to, and approved by, the Department of
Community Development that provides an enhanced level of landscaping treatments to
screen the proposed basketball court from frontage road view. Additionally, an
enhanced level of landscaping around all buildings and parking lot perimeter to be
provided in order to effectively screen the proposed cellular tower compound from street
view.
3) No outside storage is allowed and items that are being displayed for sale must be
located on the east side of the storage building and not be visible from USH 41.
4) The owner provide the City with a 4 ft. easement for the construction of a
pedestrian pathway along N. Koeller Street.
5) All signs, including temporary signs, must be placed so as to comply with
applicable setbacks.
C) 2634 W 9th Avenue; Dr William Schuster
A conditional use permit for a planned commercial development for construction of a
6,500 sq. ft. office building and associated amenities, per the attached "Exhibit C", with
the following conditions:

Community Development prior to issuance of a building permit.
All floodplain issues be resolved prior to obtaining a building permit.

D) N. Westhaven Drive; Westowne Offices, LLC
A conditional use permit for a planned commercial development to construct two
commercial office/retail buildings, and associated amenities, per the attached "Exhibit
D", with the following conditions:
1) A landscape plan be submitted to, and approved by, the Department of
Community Development prior to a building permit being issued.
2) The parking area on the east side of the site be screened in accordance with
Section 30-35(I) of the City of Oshkosh Zoning Ordinance.
