PURPOSE:
INITIAL RESOLUTION/COLD MIX ASPHALT OVERLAY- VARIOUS
STREETS
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows:
1. The Common Council hereby declares its intention to exercise its power under
Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special assessments upon
property within the following described areas for benefits conferred upon such property by
construction of a cold mix overlay on the following:
Dakota Street - 4th Avenue to 6th Avenue
Georgia Street - 11th Avenue to 17th Avenue
Osborn Avenue - Knapp Street to Georgia Street
Sanders Street - North of 17th Avenue
Michigan Street - North of 19th Avenue
Rugby Street - 11th Avenue to Osborn Avenue
12th Avenue - Knapp Street to Georgia Street
Florida Avenue - Georgia Street to Delaware Street
Hubbard Street - 19th Avenue to 20th Avenue
12th Avenue - Main Street to Oregon Street
2. Before such improvements are made, the Board of Public Works is directed to
cause water and sewer service pipes to be laid in said streets from the mains to the curb
line of each lot front on the above-named street(s), as may be needed, and to keep an
accurate account of the expenses incurred in front of each lot and report the same to the
Comptroller who shall cause the amount charged to each lot to be entered on the tax roll
as a special tax against said lot, provided, however, that the Board of Public Works shall
not cause such laterals to be so laid for any particular lot, or parcel, where, in the opinion
of the Board of Public Works, it would be impractical to do so.
3. Said improvements shall consist of cold mix asphalt mill and overlay as described
above and appurtenant work with concrete curb and gutter on both sides of the street(s),
as may be required, at a grade previously established by special ordinance of the City of
Oshkosh.

4. The total amount assessed against such district shall not exceed the total cost of
the improvements and the amount assessed against any parcel shall not be greater than
the benefits accrued thereto from said improvements.
5. The assessments against any parcel may be paid according to the provisions of
Section 25-83 through 25-89 of the Oshkosh Municipal Code.
6. The Board of Public Works is directed to prepare a report consisting of:
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of the improvements and laterals.
(c)
An estimate as to each parcel of property within the assessment
district of:

The assessment of benefits to be levied for each
improvement.
The damages to be awarded for property taken or
damages by each improvement.
The net amount of benefits over damages over
benefits for each improvement.
Upon completion of such report, the Board of Public Works is directed to file a copy
thereof in the City Clerk's Office for public inspection.
7. Upon receiving the report of the Board of Public Works, the City Clerk is directed
to give notice of a public hearing on such reports as specified in Section 66.0703(7)(a) of
the Wisconsin Statutes. The hearing shall be held by the Board of Public Works at the
Council Chambers in the City Hall at a time set by the Clerk in accordance with the
Wisconsin Statutes.
8. The installation of said street improvements shall be accomplished according to
the provisions of Section 25-3 through 25-11 of the Oshkosh Municipal Code.
