PURPOSE: INDICATE WILLINGNESS TO ANNEX AREAPROPOSED FORINCORPORATION/TOWN OFALGOMA INITIATED BY: CITY ADMINISTRATION WHEREAS, a Petition for Incorporation of a Village as a Metropolitan Village pursuant to the provisions of §66.0203 Wis. Stats. has been filed in the Circuit Court for Winnebago County, Wisconsin as Case Number 01-CV-586 for the area commonly described as the north half of the present Town of Algoma, Winnebago County, Wisconsin containing about 5 ½ square miles and over 5000 population, bounded on the east by USH 41, on the north by Lake Butte des Morts, on the west by the west town line, on the south by a line lying approximately half way between CTH E (4th Street Road also called Witzel Avenue) and 9th Street Road (also called 9th Avenue), excluding any territory in the City of Oshkosh;and WHEREAS, the City of Oshkosh has boundaries that are contiguous to the territory described in the petition for incorporation; and WHEREAS, §66.0203(6) Wis. Stats. provides that any municipality whose boundaries are contiguous to a territory proposed for incorporation may adopt a resolution indicating a willingness to annex the territory designated in such incorporation petition. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the City of Oshkosh hereby declares its willingness to annex the territory designated in the incorporation petition as commonly described above and as specifically described in the petition. BE IT FURTHER RESOLVED that the proper City officials are hereby authorized and directed to take those steps necessary to file with the Circuit Court a certified copy of this resolution in accordance with the provisions of §66.0203(6) Wis. Stats and to demonstrate in any subsequent proceedings that the willingness to annex is consistent with city planning and sound metropolitan management.
