APPLE ACRES
(B) PRELIMINARY/lST ADDITION. TO PHEASANT CREEK
FARM
(C) FINAL/PATRIARCH'S SUBDIVISION
INITIATED BY:

PLAN COMMISSION RECOMMENDATION: All approved with conditions
BE IT RESOLVED by the Common Council of the City of Oshkosh that the
extraterritorial final plat known as 1st Additon. to Olde Apple Acres, per the
attached "Exhibit A", is hereby approved, contingent upon the following:
1) "Russet Court" be changed to another street suffix acceptable to essential
services providers.
2) "Mclntosh Lane" be changed to "Mclntosh Court" due to its not being a through
street.
BE IT FURTHER RESOLVED that the preliminary plat known as 1st Addition.
to Pheasant Creek Farm, per the attached "Exhibit B", is hereby approved contingent
upon the following:
1) The developer be responsible for all capital improvements costs incurred by this
development not budgeted by the City.
2) "John Moore Drive" be changed to "John Moore Court".
3) "Fairfax Drive" be changed to another name to be approved by essential service
providers prior to recording of the final plat.
4) "Heidi Haven Drive" be changed to two separate streets at the southern property
line of Lots 70 and 83 with the name of the new street to be approved by essential
service providers prior to the recording of the final plat.
5) The unnamed right-of-way lining up with Meadowbrook Drive be dedicated as
Meadowbrook Drive.

6) A 25 ft. radius at each block corner be provided.
7) Design and construction of the detention basin be done to preserve as much of
the existing wetland vegetation and mature trees as is possible. Petitioner shall provide
a tree and wetland mitigation or replacement plan at time of submittal of the final plat for
the area of the detention basin.
8) Any additional easements be created at the request of the Department of Public
Works and approved by the Department prior to submittal of the final plat.
BE IT FURTHER RESOLVED that the final plat known as Patriarch's
Subdivision, per the attached "Exhibit C", is hereby approved contingent upon the
following:
1) The developer be responsible for all capital improvement costs incurred by this
development and that a developer agreement be entered into and approved before the
final plat is signed.
2) "Isaac Court" be changed to "Isaac Lane".
3) That the final plat include a 15 foot wide easement that would extend from Isaac
Lane southwesterly along the lot line between Lots 2 and 3 (7 ½ ft. on Lot 2 and 7 ½ ft.
on Lot 3) to the Fox River Valley Railroad right-of-way and that a 15 foot wide easement
be provided along the west lot line adjacent to the Fox River Valley Railroad right-of-
way, with said easement being available for development of a pedestrian trail and
connection to said trail if the South Lakeshore Trail is implemented in the area adjacent
to the plat, as recommended in the City's adopted Pedestrian & Bicycle Circulation
Plan. Said easement to be relinquished in 15 years from date of this document if said
South Lakeshore Trail is not implemented.
4) Additional right-of-way be dedicated to provide a radius of 25 ft. at each block
corner as required by the Department of Public Works.
