WESTHAVEN DR., EAST SIDE (C) 660 OAK ST; OAK ST. & CLEVELAND AVE. INITIATED BY: (A) MARK SHOWERS & ROBERT KROPP, PETITIONERS (B) KENT KOWALIK, PETITIONER (C) THE GREAT LAKES COMPANIES, OWNER PLAN COMMISSION RECOMMENDATION: All approved BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional use permits are hereby granted for the following properties under Section 30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as noted for each respective property, and the Planned District Overlay and final development plans, per the attached exhibits, are hereby approved. A) Capital Dr. and Venture Dr., Northwest Corner A conditional use permit to construct a tunnel style car wash, per the attached "Exhibit A", with the following conditions: 2) 3) 4) 5) 6) A landscape plan be submitted to, and approved by, the Dept. of Community Development prior to issuance of a building permit. The architectural feature shown on submitted elevations be reduced in scale and no signage be placed on such feature per the Zoning Ordinance, and additional architectural features be added above the roof line on each end of the building. Department of Community Development to approve changes to the structure. Architectural features be added to break up the expanse of the building facades by incorporating a "stripe" or some other type of aesthetic enhancement to be approved of by the Department of Community Development. Two dedicated employee parking spaces be provided on the site. Vehicle stacking not be allowed in the public street. The stacking area on-site be doubled before the business opens. JULY 24, 2001 01-298 RESOLUTION CONT'D B) N. Westhaven Dr., East Side A conditional use permit to revise a previously approved planned commercial development for construction of an unmanned 3 pump gasoline island and canopy, west of the proposed Festival Foods grocery store, per the attached "Exhibit B", with the following conditions: 1) 2) A landscape plan be submitted to, and approved by, the Dept. of Community Development prior to installation of or issuance of a building permit for any part of the gasoline island, canopy, and associated pumps. Said landscaping to meet Ordinance requirements in terms of number of plants to be planted, and at the time of planting the overstory deciduous trees proposed in the landscape plan be at least 3 ¼ inches in diameter, the clump trees be at least 8 feet high, the coniferous trees be at least 8 feet high, and the understory flowering trees be at least 2 ¼ inches in diameter. The parking spaces that are adjacent to the abutting property zoned R-3 PD be reconfigured to meet minimum setback requirements as well as being moved to a location behind the Festival Foods' and Menards' buildings. Final location to be approved by the Department of Community Development. C) 660 Oak St. and Oak St. & Cleveland Ave. A conditional use permit to revise a previously approved planned residential development for construction of a 58 unit apartment building [versus 64 units previously approved], per the attached "Exhibit C", and construction of a new 8 unit apartment building on the northwest corner of Oak St. and Cleveland Ave., as well as associated amenities, per the attached "Exhibit C", with the following conditions: 1 3) 4) 5) A revised landscape plan be submitted to, and approved by, the Department of Community Development prior to issuance of building permits. The residential developments be limited to housing persons aged 55 or older and/or the disabled, with any changes in this resident population requiring a modification to this conditional use permit. Setback of the 58 unit parking along Oak Street be no closer than 10 feet to the property line. The gazebo as shown on the submitted site plan in the front yard [at 660 Oak St.] be no closer to the property line than shown. Identification ground sign for the 58 unit building be limited to 32 square feet.
