WESTHAVEN DRIVE, EAST SIDE INITIATED BY: (B) KENT KOWALIK, PETITIONER PLAN COMMISSION RECOMMENDATION: All approved BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional use permits are hereby granted for the following properties under Section 30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as noted for each respective property, and the Planned District Overlay and final development plans, per the attached exhibits, are hereby approved. B) N. Westhaven Drive, East Side A conditional use permit to revise a previously approved planned commercial development for construction of an unmanned 3 pump gasoline island and canopy, west of the proposed Festival Foods grocery store, per the attached "Exhibit B", with the following conditions: 1) 2) A landscape plan be submitted to, and approved by, the Department of Community Development prior to installation of or issuance of a building permit for any part of the gasoline island, canopy, and associated pumps. Said landscaping to meet Ordinance requirements in terms of number of plants to be planted, and at the time of planting the overstory deciduous trees proposed in the landscape plan be at least 3 ½ inches in diameter, the clump trees be at least 8 feet high, the coniferous trees be at least 8 feet high, and the understory flowering trees be at least 2 ½ inches in diameter. The parking spaces that are adjacent to the abutting property zoned R-3 PD be reconfigured to meet minimum setback requirements as well as being moved to a location behind the Festival Foods' and Menards' buildings. Final location to be approved by the Department of Community Development.
