PURPOSE:
AMEND CONDITIONAL USE PERMIT; APPROVE REVISED
PLANNED DEVELOPMENT/W. WAUKAU AVENUE
INITIATED BY: THOMAS RUSCH & RICHARD GABERT
PLAN COMMISSION RECOMMENDATION: Approved w/conditions
WHEREAS, the Common Council previously granted a conditional use permit for
a planned residential development on the south side of W. Waukau Avenue, east of
State Rd. 44 and west of Bellfield Drive for construction, in part, of two 8 unit buildings;
and
WHEREAS, the petitioners desire to amend the development plan to construct a
single 16 unit building in the same general area, per the attached "Exhibit A".
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the planned residential development on the south side of W. Waukau
Avenue, is hereby amended to permit construction of a single 16 unit building, per the
attached "Exhibit A", with the following conditions:
1) A landscaping plan be submitted to, and approved by, the Department of
Community Development prior to any building permit being issued and said landscape
plan include additional landscaping and berming along the lot lines adjacent to existing
or proposed single family dwellings or zoning, with the construction of a fence on the
rear lot line of 2527 W. Waukau Avenue, and a fence be constructed on the west lot line
of 2527 W. Waukau Avenue with the cost shared between the developer and the
property owner at 2527 W. Waukau Avenue.
2) The developer comply with the City's Storm Drainage and Retention Ordinance.
