PURPOSE:
INITIAL RESOLUTION - WESTOWNE HEIGHTS IMPROVEMENTS
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows:
1. The Common Council hereby declares its intention to exercise its power under
Section 66.60 of the Wisconsin Statutes to levy special assessments upon property within
the following described areas for benefits conferred upon such property by improving the
following:
Westowne Heights Lots 1-15 (15 lots)
2. Said improvements shall consist of survey and inspection services for private
construction of sanitary sewer, water main, sanitary and water laterals, storm sewer, storm
sewer laterals, storm drainage and retention storm sewer, grading graveling and concrete
paving; and for survey and inspection services and public construction of sidewalk on both
sides of the street at a grade heretofore established by special ordinance of the City of
Oshkosh.
3. Before such improvements are made, the Board of Public Works is directed to
cause water and sewer service pipes to be laid, as may be needed, in said streets from the
mains to the curb line of each lot fronting on the said streets and to keep an accurate
account of the expenses incurred in front of each lot and report the same to the
Comptroller who shall cause the amount charged to each lot to be entered on the tax roll
as a special tax against said road, provided, however, that the Board of Public Works shall
not cause such laterals to be so laid for any particular lot, or parcel where, in the opinion of
the Board of Public Works, it would be impractical to do so.
4. The total amount assessed against such district shall not exceed the total cost of
the improvements and the amount assessed against any parcel shall not be greater than
the benefits accrued thereto from said improvements.
5. The assessments against any parcel may be paid according to the provisions of
Section 25-83 through 25-89 of the Oshkosh Municipal Code.
6. The Board of Public Works is directed to prepare a report consisting of:

Final plans and specifications for said improvements.

(b) An estimate of the entire cost of the improvements and laterals.
(c)
An estimate as to each parcel of property within the assessment
district of:
(1)
(2)
(3)
The assessment of benefits to be levied for each
improvement.
The damages to be awarded for property taken or
damages by each improvement.
The net amount of benefits over damages over
benefits for each improvement.
Upon completion of such report, the Board of Public Works is directed to file a copy
thereof in the City Clerk's Office for public inspection.
7. Upon receiving the report of the Board of Public Works, the City Clerk is directed
to give notice of a public hearing on such reports as specified in Section 66.0703(7)(a) of
the Wisconsin Statutes. The hearing shall be held by the Board of Public Works at the
Council Chambers in the City Hall at a time set by the Clerk in accordance with the
Wisconsin Statutes.
8. The installation of said street improvements shall be accomplished according to
the provisions of Section 25-3 through 25-11 of the Oshkosh Municipal Code.
