MODIFY DEVELOPER AGREEMENT TERMS/100 BLOCK
REDEVELOPMENT PROJECT
CITY ADMINISTRATION
WHEREAS, the Common Council previously approved the terms for a Developer
Agreement for the 100 Block redevelopment project to consist of, at a minimum, three
floors of commercial/office space, a fourth floor of residential apartments and
underground parking; and
WHEREAS, the developer now desires to modify the proposed Developer
Agreement to eliminate the fourth floor residential apartments due to concerns by some
of the prospective office tenants of the building, thereby reducing the overall proposed
square footage.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the modification to the Developer Agreement for the 100 Block
Redevelopment Project to eliminate the fourth floor residential requirement thereby
reducing the minimum project size to three floors of approximately 16,000 sq. ft. with
one level of underground parking, is hereby approved, and the proper City officials are
hereby authorized and directed to enter into an appropriate revised agreement with
Ganther Construction and Professional Realty and Development Corporation, and to
carry out all actions necessary to implement the City's obligations under the Developer
Agreement, as revised.
