WESTHAVEN DRIVE (B) 2851 ALGOMA BOULEVARD (C) 3105 S. WASHBURN STREET INITIATED BY: (A) WESTOWNE CENTRE, LLC., OWNER/PETITIONER (B) MURPHY CONCRETE CORP., OWNER/PETITIONER (C) EVERGREEN HOSPITALITY LLC, OWNER/PETITIONER PLAN COMMISSION RECOMMENDATION: All approved BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional use permits are hereby granted for the following properties under Section 30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as noted for each respective property, and the Planned District Overlay and revised final development plan, per the attached exhibit, is hereby approved. A) CONDITIONAL USE PERMIT/VVestowne Avenue & N. Westhaven Drive A conditional use permit for a restaurant with a drive-thru pick up window on the east side of the proposed Westowne Centre, per the attached "Exhibit A". B) CONDITIONAL USE PERMIT/2581 Algoma Boulevard A conditional use permit to construct a concrete batch plant, to include but not limited to, a 43' x 25' metal building, conveyors, silos and hoppers, per the attached "Exhibit B", with the following conditions: 1) 2) 3) The driveway(s) from Algoma Boulevard to the plant facilities be asphalt. A parking plan be submitted to, and approved by, the Dept. of Community Development. The plant meets all local and state regulations pertaining to noise and dust APRIL 24, 2001 01-174 RESOLUTION CONT'D C) CONDITIONAL USE PERMIT; REVISED FINAL PLANNED DEVELOPMENT/ 3105 S. Washburn Street A conditional use permit to revise a previously approved planned commercial development to construct an 11,000 sq. ft. banquet hall, installation of a 13' x 3.5' wall sign on the banquet hall, and a 0 ft. side yard setback between the proposed banquet hall and parking lot, and the hotel and parking lot, per the attached "Exhibit C", with the following conditions: 1) 2) 3) 4) 5) 6) 7) A certified survey map must be used to divide the land. A cross access and cross parking agreement be submitted to, and approved by, the City of Oshkosh and recorded with the Register of Deeds. No additional driveways from the public right-of-way to the subject lots be allowed without approval by the City of Oshkosh. State approval be obtained for all issues involved with constructing a building with a 0 ft. setback prior to obtaining a building permit from the City of Oshkosh. A revised landscape plan to address the additional developed area and parking be submitted to, and approved by, the Dept. of Community Development. No additional signs be allowed on the site unless the development plan is revised and approved by the City of Oshkosh. A 15 ft. side yard setback must be maintained on the south side of the proposed lot containing the banquet hall and parking lot.
